Sheriff in Ill. county won't evict in foreclosures

Oct 8, 2:19 PM (ET)

CHICAGO (AP) - Residents of foreclosed properties in Chicago and other parts of Cook County don't have to worry about deputies forcing them out. Sheriff Tom Dart says that starting Thursday his office won't take part in evictions.

Dart says he's concerned that many of the people being evicted are renters who were unaware that their landlords have been failing to pay their mortgages. He says his deputies have no way of knowing whether they're removing someone who has defaulted on a loan or someone who has been faithfully paying rent.

Dart says he thinks he's the first sheriff in a major metropolitan area to stop such evictions during the ongoing foreclosure crisis.

Dart says the number of mortgage foreclosures in Cook County has skyrocketed and will probably keep rising.

Wont he be fired for not doing his job. I mean, it is a nice gesture but in the end the evictions will get done so he may as well do them and save his own job.

It has got to be heartbreaking to do, if you have a heart that is.

3. Sherriffs are elected, I think.
They might sue him, but I doubt they'd fire him. And who could think he wouldn't win re-election?

... stopping all mortgage foreclosure evictions until lenders can prove renters have been notified.

Dart conceded the action could leave him open to contempt of court for not carrying out eviction orders, but said, "We are no longer going to be party to something that is so unjust."

The suspension will apply only to houses, condominiums and other properties in foreclosure. Evictions for lease violations by tenants who have not paid their rent will continue.

Dart is taking the action until banks and other mortgage holders submit affidavits in court showing whoever is living in the home has been given the proper 120 day notice to get out.

6. Banks should forgive all debt.
They can't play with any money until they can learn to do so safely. BAD banks. BAD. NO MONEY.
