Medical Marijuana Patients Can be Prosecuted, Federal Court Rules

SAN FRANCISCO (AP) -- A federal appeals court ruled today that federal drug agents could arrest on drug charges a California woman whose doctor says marijuana is the only medicine keeping her alive.

The case focuses on whether the gravely ill have a right to marijuana to keep them alive when legal drugs fail. And the case is also likely to reach the U.S. Supreme Court, despite the ruling by the Ninth U.S. Circuit Court of Appeals.

The case was brought by Angel Raich, an Oakland mother of two, who suffers from scoliosis, a brain tumor and other ailments. On her doctor's advice, she eats or smokes marijuana every couple of hours to ease her pain and bolster her small appetite.

The Supreme Court two years ago came down against Raich.

You can't smoke cigs on your own property soon in some places, and now they are coming even harder after pot smokers who are in poor health.

MM is the only drug that works for some folks. By denying her her MM, they have most likely signed her death sentence.

Oh wait, I forgot, medicinal marijuana is a gateway drug, and this poor suffering lady is endangering ALL of our children with her miscreant behavior. She must be stopped!

6. I briefed the Raich vs Gonzales SCOTUS case...
for one of my paralegal classes. IIRC, their decision basically said that if Ms. Raich and others wanted to avoid federal prosecution, they needed to get Congress to reschedule marijuana and change the laws.

I'm not saying that this decision doesn't suck the big one - because it does! But we need to make the changes at the federal legislature. The federal courts aren't going to give us any help at all apparently.

Damn all of them. This failed War on Drugs/Marijuana has turned us into a police state and has ruined more lives...This so pisses me off...I'm just REALLY pissed off right now; so pissed I can't even think straight. I wish I had some pot, I'd probably feel a lot less stressed about it!

8. Encouraging words in the federal ruling
This statement was in the federal ruling:


"For now, federal law is blind to the wisdom of a future day when the right to use medical marijuana to alleviate excruciating pain may be deemed fundamental. Although that day has not yet dawned, considering that during the last ten years eleven states have legalized the use of medical marijuana, that day may be upon us sooner than expected."


We need to get off our asses and get Congress to pass a national medical marijuana bill.
