RFK, Jr.: There are about 30 scams the Republicans are deliberately using, particularly in the swing states to get Democratic voters off the rolls. These scams originate in the so-called Help America Vote Act, which was passed after the Florida debacle in the year 2000. It was originally suggested by Democrats and Republicans, but it was passed by a Republican Congress with a Republican senate and a Republican president. And instead of reforming what happened in Florida it basically institutionalized all the problems that happened in Florida. And institutionalized a series of impediments that make it very difficult for Democrats to register, for Democrats to vote and then for Democrats to have their votes counted.

One of these requirements under HAVA is called 'the perfect match,' and what that does is little known but it is devastating. A quarter of the voters in Colorado have just been removed from the rolls because of this-- just this one scam. And what it does is, they use a computer system to compare your registration application to all other government records in the state. So they'll look at your Social Security records, your Motor Vehicle records, and any time you've had any interaction with the government, and if there is any information on your voter registration that is different than the information on another government record that they find, they remove you from the voting rolls.

For example, if I registered as Robert F. Kennedy Jr., and yet my motor vehicle license said Robert Frances Kennedy Jr., I'd be removed from the rolls. If your initial is different, if you leave an initial out, if you leave a "Jr." out, if you leave a hyphen out in your name. And what they've done is a study in New York that said 80% of the errors are errors by state clerks taking down this information. And particularly immigrant communities, people tend to vote Democratic, people have namesŠspell Muhammad with an "o" instead of a "u"

Papantonio: Are the Democrats suing to stop this?

RFK, Jr.: No, the Democrats are doing nothing to stop it. In New Jersey, which is a swing state, 300,000 voters in New Jersey were just sent letters saying that they are now ineligible to vote. New Jersey is nice enough to actually notify them--most states will not even notify them. And New Jersey intends to send out 870,000 letters so that is three quarters of a million people off the voting rolls in a state that could decide this vote by 50,000 votes. And these are Democrats that are being pushed off the rolls.

Let me tell you about one of other scams people should know about. If you're a newly registered voter--and of course the Democrats have done these gigantic registration drives--12 million people on registration--if you're a new voter, you MUST include your license or some other state I.D. when you come to vote. What that means is that if you're a college kid--and college kids now, they're sending in absentee ballots, they're not going to the voting place, they do everything online or they do everything remotely. They don't dream of going to the precinct house voting on election day and waiting in a long line. So if they send in the absentee ballot, and they don't include a color copy of their license, their vote is going to be thrown into a trash can. And none of these people know this, because you had to have to read the law in order to know it. There is no notification when you fill out your registration form, so all of those 12 million people that the Democrats have registered--those ballots are going to be just thrown out.

Papantonio: And if Democrats won't talk about this, how the hell's anybody gonna know about it? I'm involved with this kind of thing every day--I didn't know that until you just told me. The media is not talking about it. How in the hell is somebody gonna find this out? It's just incredible.

RFK, Jr.: Hopefully--Obama is getting $66 million a month--hopefully somebody in the Democratic organization is going to pay some attention to this before Election Day.

the incumbents stay pretty well protected regardless of Party. Only a handful ever lose their seat, and they move right over to K Street with a hefty pay raise.

17. Maybe it's paperwork related.
Remember, we have to prove if a crime is committed--innocent until proven guilty, etc.

Then there's the "oopsies, my bad!" excuse of it may have happened, but it was not malicious.

But, I think the problem is asking people to

1. know that they are being prevented from voting
2. challenge the caging
3. find out how to fix the problem
4. re-register before the election

The burden has been placed on the voter, of course.

BTW, this is a classic example of election fraud.

30. What we're doing in Tennessee to fight this (something you can do wherever you are)
Here in Tennessee, we are asking our county election administrators to give us a data-tape of everyone who has been purged from the voting rolls in each county. We do not register by party in TN, but information on which primary the voter has participated in is included on the data-tape, which works just as well. The data-tape also has address and phone number of each purged voter, which should make follow-up easy.

We will notify every Dem voter we can contact that they have been removed from the rolls and we will do everything we can to get them re-registered in the three weeks we have left to get them re-registered. I would encourage EVERY state to do this NOW.

If we never stop fighting, we cannot lose.
But first, we have to START fighting -- and stop farting around.

24. I just sent it to my friends in Colorado since it specifically mentions what
they are doing there and told them to try and get it in front of the people they know in the O campaign. I also sent it to my daughter because of the section about disenfranchising newly registered voters, a great deal of them college students. The interview doesn't mention specifically what the letters sent out to NJ people telling them they aren't registered anymore say. I hope I didn't get one of those letters and just not open it thinking it was generic. What do those say, the same thing as the Colorado 'perfect match' sleeze move. This is so upsetting. They cannot win unless they steal it and they always seem to steal it and get away with it every damn time. NOT THIS TIME (please).

My first name is Mary Ellen. That is not my first and middle name. I have no middle name. I had to search for my voter registration on-line which was under Mary E. -- turning part of my first name into my middle initial. That was definitely a clerk entering that info, because I never would have entered it that way.

My Drivers License has Mary Ellen.

Does this mean they could pull my vote?

AND -- how do we know if they do that? Would my name not be on the roster when I went in to vote, or do they do the axing afterward?

This is really, really, alarming.

8. One of the things YOU can do...
is to join National Guarantee Your Vote Day on October 1, 2008 on that day commit to 2 actions...one check with your local state or county elections officials either online, in person or by phone and MAKE SURE that you are still registered to vote. The other is to send a like email out to all you know prompting them to do the same. I know it's not much, but it could save some votes in close races ALL the way down the ticket.

it's built into the system by the repukes...hire people at such a shit wage (making just enough to not starve and keep a roof over their heads) but no enough to actually care. 70. He has been working on party infrastructure in the neglected states the last 4 yrs. He's not asleep,
he just targeted Sec of state races to add muscle to the efforts in certain crucial states like Ohio.

He has been successful growing muscles for Dems in many states to a degree, but, now requires he make more public an effort to directly counter the tactics of the RNC and GOP officials - and do so WITH the cameras rolling.

45. in Minnesota as well, we have same day registration
so folks who are bumped from the rolls can register on election day in a variety of ways. We can even register the homeless.



Every state needs to be addressing this problem, so that voters will have a chance to exercise their right to be heard.

He should get his whole damned family to hold a massive press conference highlighting this scam. The news media couldn't ignore such a thing--they are Kennedys, after all, and a large Kennedy press coneerence would be something that would attract attention. Maybe add a couplke of Cuomos and other Democratic family dynasties to the mix.

They should also contact The National Enquirer and other tabloids that a lot of people read who don't even read newspapers and news magazines. Maybe even People magazine. Get the info to the voters themselves, along with isntructions about how to check if they are properly registered to vote, and what to do if they aren't--as well as the time frame it has to be accomplished in.

Volunteers who are registering new voters also need to be informed, massively, and encouraged to add voter registration checks to their activities.

They could even contact Whoopie and Barbara on The View. Those two ladies have shown themselves to be pretty disgusted with McCain's sleazy campaign and they might be willing to help get the word out. Oprah would be a great contact, since she reaches millions and they listen to her. These TV hosts wouldn't even need to make it a partisan thing. All they would have to do is explain the laws and how they are being used, without specifying parties. The Dems will know they are the ones being targeted and then could take action to make sure they are registered accurately. If MTV is doing a "Rock the Vote" thingie this year, they could be brought on board, too.

Finally, once this election is over, a big noise has to be made--and these high profile folks could help us make it--to get these repugnant laws rescinded.

this is exactly what is happening. Van Hollen, republican attorney general, has brought a suit that fits RFK Jr.'s description to a T. It is pretty clear that he wants to shut the democrats down. In my opinion, this is a crime being perpetrated right before our eyes. On Sunday, there was an opinion piece in the Milwaukee Journal Sentinel that referred volunteers to Election Protection at www.866ourvote.org. We can volunteer on Nov. 4 to help oversee what goes on at the polls. But I am concerned about the weeks before the election during which time thousands of voters may be wiped from the rolls. How can we help in Wisconsin???

Someone somewhere has to do something. It is a fatal mistake to just think that a case here or there is going to make a difference. It has to be totally publicly addressed. Cannot loose this election. Cannot loose. The Dems have got to do something. This whole damn election should be by paper ballot with tons of witnesses.

40. You would be amazed at how many people on DU think this is a "non-issue". Every time I or
someone else says Obama is not going to win just because he's registering millions of new voters, we get accused of being NEGATIVE.

It is fucking scary how ill-informed, ignorant, and naive people are.

Whoever said it's because the incumbents are already feeding at the trough is absolutely right. If you're way up in the party hierarchy you're either ALREADY WEALTHY AND WELL-CONNECTED or you're in line to be. That's the only explanation I have for it.

last time, we did not know how to tell. we waited and wondered who could prove it, and who would do anything. but this time- the polls are lying. this election is not close. if they try to say that mcsame is the winner, we just know that is a lie.
so, if they say barack lost, we have to take to the streets. remember, remember the 5th of november.

ABC News' Karen Travers and Arnab Datta report: The Obama campaign and DNC have filed an injunction in federal court as an effort to challenge what they deem as illegal voter suppression of people whose houses are in foreclosure.

The injunction is in response to the comments last week from the Macomb County (MI) Republican Party chairman, James Carabelli, who said: "We will have a list of foreclosed homes and will make sure people aren’t voting from those addresses."

On a conference call with reporters, Bob Bauer, general counsel for the Obama campaign, said this practice is illegal and would be used to intimidate and prevent people from going to the polls.

Bauer said that one out of every 285 households in Macomb County have been foreclosed on and MI Democratic Party Chair Mark Brewer said that in July 2008 alone, over 11,000 households in Michigan received foreclosures notices.

Democratic voters in at least two Wisconsin communities have received absentee voter forms from the McCain campaign that -- if used -- could cause their votes to be ignored.

Is it a simple error? Or campaign shenanigans and voter fraud? You be the judge.

Keith Heck, a former Racine Unified School Board member who lives in Mount Pleasant, reports receiving a mailing containing two tear-out requests for an absentee ballot. The preprinted request form -- an 11x17 piece of card stock folded over twice for mailing -- is addressed to the clerk in the the village of Caledonia.

Heck says, "I spoke with the Caledonia clerk and learned if we (in Mount Pleasant) used the form and sent it to the pre-printed address they would have to forward it to the right jurisdiction (if they had the time and the people) who would then have to send out the absentee ballot. As the deadline to submit a request is Oct. 30, and the clerks have a deadline of Oct. 31, this bogus form not only gums up and overworks the process to get absentee ballots sent out, it could cause some to not even be mailed."

The election officials Heck spoke to -- Racine County and Caledonia -- said sending the absentee ballot request to the wrong clerk would not jeopardize a voter's registration, but might result in the absentee ballot not getting sent due to overworked personnel, or the possibility of missing the deadline.

Another report comes from Jennifer Jackson, a Kenosha County supervisor. She says a friend in Middleton received similar McCain literature, containing a large post card which was an application for absentee ballot. The return address was wrong. Instead of the Middleton address for her clerk's office , it was a Madison clerk's office address. Had she filled this out and sent it back, "her vote would never have been counted," according to Jackson.

Jackson -- full disclosure requires us to note that she's a Democratic Party activist -- said: "My friend is very involved with the Obama Campaign in Middleton. She called many of her friends and found they had the same thing. They debated whether or not to send them in at McCain expense, then they realized the return address was not Middleton but in fact a Madison address."

Jackson says, "I do not for one second think this was an error on the part of the McCain side. They deliberately mailed to strong Democratic voters and deliberately tried to derail their votes."

Otherwise, she asks, "Why mail to established Democrats who have no intention of voting for McCain? Why did everyone with a Middleton address have the same mistake of a return to the Madison Clerk's office? "It is clear," she adds, "that , not trusting E-voting, many Democrats are absentee voting this year. Did the McCain camp think by mis-routing these applications their votes would not be counted? It is true, they would not have been."

Heck also subscribes to the dirty tricks theory. He notes, "I was listening to Air America Radio yesterday and today and it sounded like this was happening around Wisconsin and even in Michigan. If you received this mailer and sent in a request you may want to follow up with the clerk you mailed it to, or call the clerk for your municipality and explain to them what happened to get this corrected. You may also want to forward this to your friends to alert them to his situation. If you have the mailer, check to see if it’s to the right clerk, hold on to the form and ... let our community know how broad this problem is."

Bryan Miller, chair of the Kenosha Democratic Party, says he never received a flier from a Republican candidate in the eight years he's lived in Wisconsin. "Frankly, as I was getting the mail out of the mailbox yesterday, I about fell out of the car when I saw the McCain flier." His had the correct mailing address on it, but he said more than a million Obama supporters in Ohio received an absentee ballot from the McCain campaign that included an "extra" check box "by accident," and were thus deemed invalid.

Miller said he talked to Kyle Richardson of the Wisconsin Government Accountability Board, who said he received a report of someone who had moved, but got a flier with the mailing address of the municipal clerk serving their old address. "If you send the application to the wrong clerk, it will invalidate your voter registration, essentially moving your registration to the new municipality," Miller said.

Anyone receiving the flier with the wrong address is urged to call the GAB at 608-266-8005 to report it. Or, you can email the GAB with a scanned copy of the invalid portions, or file a complaint here.

As voter registration efforts continue across our country over the next few months, those who lead those efforts would do well to keep in mind the critical role of voter purging in our last two presidential elections.

No, I am not in the least discounting the need for aggressive voter registration efforts. Rather, I am suggesting that without efforts to counteract illegal voter purging, much of those efforts could go for naught – as they did in 2000 and 2004.

I am currently working with the Election Defense Alliance on a project to prevent a recurrence of the disastrous purges of 2000 and 2004, in 2008.

Evidence on how illegal purging of voters helped George Bush win the Presidential elections of 2000 and 2004 can be found at this post, which I just posted in General Discussion.

The investigations described in the above noted post were undertaken after the respective elections – when it was too late to do anything about correcting the illegal voter registration purges or the election results. Nor was the Bush administration Justice Department at all interested in investigating any of these issues. But what if these problems had been discovered prior to the elections?

What we would like to do is identify voter registration figures in selected counties throughout the United States, at various points in time following the 2006 elections. We are interested in identifying the number of registered voters in those counties between December 2006 and the present, and we also want to know how to follow those numbers from now until the 2008 election.

The goal is to be able to identify suspicious decreases in the number of registered voters, which could be indicative of illegal voter purging. Those situations would then be investigated further, in an attempt to ascertain the reasons for the suspicious decreases, and then take corrective action if possible.

The 15 states that appear to be of greatest interest are: Michigan, Ohio, Pennsylvania, Wisconsin, Iowa, Nevada, Colorado, New Mexico, Florida, Missouri, Virginia, New Hampshire, Indiana, Montana, and North Dakota. Targeted counties in those states would be perhaps the 3-5 largest counties in the state, or any other county that would appear to be especially susceptible to voter purging.

If you have any information or links that would help us obtain the data that we are looking for in any of the above noted counties and states, please let me know – either through this post or by pm.

I will also be cross-posting to the respective state forums and the Election Reform forum.

plus, CNN is misleading viewers about Obama/Biden on a bridge vote. CNN has never mentioned the coup of 2000. Will they mention the voter fraud on 2008? I doubt it.

We are the ones we've been waiting for. If you don't know how to be effective in terms of voter fraud by alerting the media and DNC and Obama officals then take to the phones and knock on doors.

We cannot expect Obama's people to even check this website and WE have to take the lead.

This is grass roots. One person, or one thread, or one website CAN make a difference.

The highly respected Brennan Center for Justice at New York University's School of Law, has a comprehensive, well researched and documented white paper by Justin Levitt on recent allegations of voter fraud allegedly occurring in Wisconsin and other states within the last eight years, entitled, "The Truth About Voter Fraud."

Once you read it, your eyes will be opened to the sham that is being perpetrated upon the U.S. voters. In fact, one could easily argue that the widespread rumors of voter fraud exist to confuse the populace and further deepen the cynicism of our electoral process. These efforts may also serve a larger agenda to keep real voting reform off the table, that is, extending the time people are allowed to cast votes; make it LESS burdensome for people to vote in the first place; and acts by political campaigns to buy votes, among many others.

A nonpartisan task force is being created to investigate the claims of voter fraud in Wisconsin. They could save a lot of time and money by simply reading this excellent report RIGHT NOW.

Since the 2004 election, there have been persistent, unsubstantiated rumors of voter fraud in Wisconsin, and Milwaukee in particular. Wisconsin Attorney General J. B. Van Hollen, who is also co-chairman of the Wisconsin campaign of presidential candidate John McCain, is knowingly using these unsubstantiated rumors in his efforts to suppress legitimate votes in Wisconsin this November.

As reported elsewhere, Van Hollen has a serious conflict of interest here.
This attack on Wisconsin voters by the GOP and Wisconsin's own attorney general is also part of their support to enable the Real ID act, a costly, burdensome requirement that will do nothing to clean up state elections. From the report:

The 2004 election was hotly contested in Wisconsin, and various irregularities led to inflated claims of widespread fraud. At the same time, Wisconsin citizens were debating a proposal to require restrictive identification of each voter at the polls, and the fraud claims were used to support the call for ID. We examined each of the allegations of fraud by individual voters—the only sort that ID could possibly address—to uncover the truth behind the assertions ... these claims of voter fraud are frequently used to justify policies that do not solve the alleged wrongs, but that could well disenfranchise legitimate voters. Overly restrictive identification requirements for voters at the polls — which address a sort of voter fraud more rare than death by lightning — is only the most prominent example.

Here are the bogus allegations of voter fraud in Wisconsin, with clear and concise research that exposes the truth. I encourage you to read the entire report.

Invalid addresses: Based on an attempt to match voter roll entries to the U.S. Postal Service’s database of street addresses, 37,180 people in Milwaukee were alleged to have registered from invalid addresses. Of these, 31,500 listed accurate street addresses, but had problems with an apartment number. Further review of the remaining allegedly invalid addresses revealed cases in which the list was corrupted; digits were dropped on some entries, making otherwise valid addresses appear fictitious. This review also showed typos turning valid addresses into invalid ones. Though reporters following up on the story could not locate 68 listed addresses, at least 400 addresses were affirmatively proven to be valid. The bipartisan Milwaukee Election Commission ultimately threw out a challenge lodged to 5,619 of the entries, citing insufficient evidence that the registrations were invalid. Still, poll workers were specifically instructed to ask challenged voters for proof of residency, so every voter on the list of 5,619 should have been asked for proof of proper residency.

1,242 Milwaukee votes were cast from allegedly invalid addresses, based on another computerized match; this match paired voter rolls with U.S. Postal Service and City of Milwaukee property lists, with spot checks of 40 specific addresses.191 A sample of 300 of the entries showed that about 20% of the invalid addresses were attributed to data entry errors (e.g., “3130 S. 15th Place” became “3130 S. 15th St.,” and “S. 68th St.” became “S. 63rd St.”). At least two other addresses ostensibly deemed business locations were found to be valid residences after an individual spot-check. Furthermore, 75% of these votes were from Election Day registrants, who were required to show proof of residence at the polls.


Faulty registration cards: In Milwaukee, 10,921 voter registration cards from Election Day voters were allegedly unable to be processed. This allegation turned out to be an error; in fact, 1,305 Election Day registration cards from Milwaukee could not be processed. 548 of these listed no address, and 48 cards listed no name, but voters had to show both proof of name and proof of residence to register on Election Day. 236 cards had missing or incomplete dates of birth, 28 had no signature, 141 listed addresses outside of the city limits, and 23 were deemed illegible. 155 cards were not processed because they had not been given a voter number by the city. It is unclear why the remaining 126 cards could not be processed.
3,600 address verification cards mailed using information entered from these Election Day registrations were returned as allegedly undeliverable. We are not aware of any further public investigation of these cards.
2,200 address verification cards from outside of Milwaukee, mailed using information entered from Election Day registrations, were also returned as allegedly undeliverable.196 313 of these were from Racine: 207 were returned because the voter moved after the election, and at least 24 addresses were entered incorrectly by election workers.Of the 1,887 returned address verifications of Election Day registrations from elsewhere around the state, 1,198 were returned because the voter moved after the election or was temporarily absent when the card arrived; 610 showed a valid address but the individual could not be found there; 36 had an incorrect street number; 2 had an incorrect street name; 9 had a missing apartment number; 9 were sent to an address with no mailbox; 2 were sent to vacant addresses; and 21 were returned for some other reason.


Ineligible by conviction: The organizers of one pre-election jailhouse absentee ballot drive conducted a records check on 400 inmates who had signed up, found 18 ineligible, and alerted election officials; no votes were cast by these ineligible persons.
376 individuals allegedly rendered ineligible by felony conviction cast ballots, based on an attempt to match voter rolls and information from the Department of Corrections. 96 individuals listed as voting in Milwaukee matched name, address, and birthdate against Department of Correction records, and 182 individuals listed as voting matched only name and address. At least one appears to have been erroneously listed as voting; he is listed as voting but claims that he did not, while his wife is not listed as voting, but did cast a ballot. Another 98 people listed as voting elsewhere around the state matched name, address, and birthdate against Department of Correction records, but at least 7 were convicted after the election, and were eligible at the time they cast their ballot.
13 voters have been formally charged with fraudulently voting while ineligible; of these, 7 have been convicted, 1 voter was acquitted, 1 case was dismissed upon evidence that the voter was eligible when voting, 2 cases were dismissed for other reasons, and 2 cases were dismissed despite evidence that the voter was ineligible. In one of the latter cases, the voter provided his Department of Corrections identification card at the polls, which had “OFFENDER” printed in bold letters across the face, but was not told that he was ineligible to vote.

3 others were documented as voting while ineligible but have not been charged. An additional voter documented as ineligible was found in 2006.

Double voters: A computer glitch in Milwaukee caused at least 314 voters who re-registered before or on Election Day to be listed twice on the rolls, with a notation of voting next to each listing. Each was given only a single ballot.
83 people allegedly voted twice; 14 allegedly voted both absentee and in person, 9 allegedly voted in Milwaukee and other cities, 59 allegedly voted twice in Milwaukee, and 1 allegedly voted twice in Madison.205 Of the 59 voters alleged to have voted twice in Milwaukee, most registered twice but voted only once. 51 were cleared by investigators, 1 was acquitted at trial, 1 received no verdict at trial, and 1 was found incompetent to stand trial.
Finally,another voter named Gloria Bell believes that she was confused with a woman named Gloria Bell-Piphus.
Of the 9 voters alleged to have voted both in Milwaukee and in another city, all 9 were cleared of wrongdoing: clerical and scanning errors by poll workers accounted for 6 of the voters, 2 were fathers and sons alleged to be the same person, and 1 had a different middle name and birthdate from his alleged double.
Of the 14 voters alleged to have voted both absentee and in person, in at least 12 cases, after comparing absentee records to poll records, the absentee ballot was not counted.

Dead voters: 4 votes were cast in the names of allegedly dead people.208 These were all absentee ballots, cast by individuals who died within two weeks of the election; it is not clear whether the ballots were cast before the individuals died.

Impersonation: 1 vote was allegedly cast in the name of an individual who did not vote. Further investigation of the alleged vote cast in the name of another was determined to be a clerical error by a poll worker.

Fictitious voters: 2 votes were allegedly cast in the name of an individual who could not be verified as an actual individual.212 These votes were cast in the name of Marquis F. Murff, who could not be verified by a reporter as an actual individual. We are not aware of any further public investigation.

Underage voter: One ballot was cast by a 17-year-old voter, using his real birthdate.

Noncitizen: One columnist reported that a ballot was allegedly cast by a Canadian legal permanent resident. We are not aware of any further public investigation.

Faulty registration: Four individuals allegedly submitted false voter registration applications. 2 Milwaukee residents were convicted for submitting false voter registration applications; 1 person alleged to have supervised two others who turned in false forms was also convicted, but that conviction was overturned. The trial of one other individual accused of submitting false registration applications is still pending. No votes were alleged to have been cast under these registrations.

MADISON, Wis. -- With only seven weeks to go until the presidential election on Nov. 4, authorities said a task force including state agents and Milwaukee police is being formed to fight election fraud.

Plans for the task force are to be announced Wednesday.

It's expected to include agents from the state Department of Justice and investigators from the Milwaukee police force to look into any possible fraud in the November election.

Attorney General J.B. Van Hollen and Milwaukee County District Attorney John Chisholm are working together on the task force.

The move comes as a nonpartisan watchdog group has recognized Wisconsin as having the best voting and election laws out of 10 swing states in the presidential election.

The report by Common Cause praises the state's poll worker training standards, its requirements for one voting booth for every 200 registered voters and its voter registration at the polls.

Along with Wisconsin, Common Cause studied the laws in Colorado, Florida, Georgia, Michigan, Missouri, New Mexico, Ohio, Pennsylvania and Virginia.

Arizona Activists Outline Evidence of 2006 Electronic Vote Theft, By Bill Risner, Election Defense Alliance, Posted on July 22, 2008

Editor's Note: Electronic vote count fraud is very hard to prove. Yet for several years, a group of election integrity activists and Democratic Party officials in Tuscon, Arizona, have made as much progress as anyone in the country. At issue was a 2006 regional transit bond vote that was behind in pre-election polls but won on Election Day. Attorney Bill Risner, the Pima County Democratic Party, and AuditAZ, an election integrity group, sued and won the release of the vote's electronic records. That established for the first time in the country that such data was a public record. Now Risner and the activists have a sworn confession from a whistleblower who says he was told the transit bond vote count was altered and much related evidence. In this recent letter to Arizona Attorney General Terry Goddard, Risner asks the state to reopen its own investigation and recount the 2006 ballots.

Dear Mr. Goddard:

I sent you a short letter on July 9th, 2008, together with Mr. Zbigniew Osmolski's Affidavit,. I will be out of the County from July 15 through the end of the month. Accompanying this letter are various materials that may help you to better understand the nature of the allegations and more fully understand the past investigation by your office staff.

At the beginning of the database lawsuit, the Pima County Democratic Party, and I personally, had confidence in your Office's integrity. Additionally, I was sensitive to political currents. That is why I informally told Jim Walsh what we were finding out in our lawsuit against the Pima County Board of Supervisors. It was a "heads up" conversation relating to him that we were acquiring evidence suggestive of criminal activity but not enough in my opinion at that point for your office to open an investigation and none was requested.

Election theft 2008: available in a neighborhood near you

If you've been living in a cave the past 8 years, you might not know about the corporate coups that has taken control of America's democratic elections. In this article, Zeese lays it out in living color.

In NH, our public officials have recklessly and irresponsibly given the private corporation, Diebold Election Systems, unconditional, unmitigated, and what could very likely be illegal control over the vote count of at least 84% of NH ballots. Citizen efforts to enact protective legislation have been rebuffed by both the NH Republican and Democratic leadership, each in their turn.

Citizen efforts to implement protective procedures and processes have been ignored by the NH Department of State. As a result of this betrayal by the NH state government, 84% of NH voters no longer enjoy democratic, publicly owned elections; the state has given their democracy away to corporate interests who claim proprietary trade secrecy over what is supposed to be a public vote count.

Whatever happens in November 2008, there is one verifiable fact and truth: in NH, only Diebold Election Systems has the power to determine and declare the winners of the 2008 election.

Election Theft for 2008 Already Underway

The campaigns are in full gear, the candidates are picked, TV ads are running, and election corruption is taking hold. Around the country, particularly in swing states, there are stories of efforts to undercut voter registration especially by poor and African American voters. In addition, this summer has seen story after story of the potential corruption and likely dysfunction of electronic voting machines.

The combination of corruption of the voter registration system and corruption of the vote counting machinery means that 1 + 1 is not likely to equal 2 when it comes to counting the vote. The public is better informed and more fed up than ever with these election shenanigans. It is time to get informed and organized so that Americans will join together and refuse to accept another stolen election.

Voter Registration Corruption: Suppressing the Vote in Key States

It is the season of intensive voter registration drives - Virginia, for example, just ordered 200,000 voter registration forms because of shortages - and of voter suppression efforts as well. Throughout the country, particularly in battleground states, Republican voter registration challenges are moving forward aggressively.

In the last two presidential elections voter suppression may have been the key to Republican "victories." (Note: I am not a Democrat or Republican. I am a voter that does not support either of the major political parties manipulation of American democracy.) Many have concluded that the 2000 election was corrupted in Florida by operatives in the Jeb Bush administration who suppressed the black vote and undermined the vote count, as well as by the partisan Supreme Court justices who stopped the recount. But, now it is also evident that the 2004 election was corrupted by the Republican Secretary of State in Ohio who undermined voter registration in black communities and made sure that there were not enough election machines in Democratic Party-leaning precincts. Now, we are seeing many of the techniques used in those elections to suppress the vote in 2008. The McCain-Palin campaign and Republican Party are aggressively seeking ways to reduce the number of Democratic voters. Here are a few examples:

- The chairman of the Republican Party in Macomb County, Michigan, a key swing county in a key swing state, is planning to use a list of foreclosed homes to block people from voting in the upcoming election as part of the state GOP's effort to challenge voters on Election Day. Ohio Republicans are considering the same tactic. This mean-spirited approach to denying people their vote will not only intimidate voters but will create long lines in Democratic-leaning precincts. A coalition of faith-based, community and labor organizations protested outside of McCain-Palin's Michigan office against this tactic.

- In Wisconsin, Attorney General J.B. Van Hollen a Republican and co-chair of the McCain-Palin Campaign in Wisconsin, filed a lawsuit demanding Wisconsin election officials verify voters' identity before the November election. This could lead to frustration at the polls and exhausted clerks in a hotly contested state in the presidential race. One million people have registered since January 1 and if successful the lawsuit would require every new registrant be checked.


- The Florida Secretary of State decided on September 8th to enforce the state's "no-match, no-vote" law, a voter registration law that blocked more than 16,000 eligible Florida citizens from registering to vote in 2006, through no fault of their own, and could disenfranchise tens of thousands more voters in November. Republican Secretary of State Kurt Browning's last-minute decision to implement the law in the final month before the registration deadline will post a significant hurdle to eligible Florida citizens hoping to vote in November. It will disenfranchise voters who do not send or bring a photocopy of their driver's license to county election officials' offices after voting, even though these voters will have shown their driver's licenses when they went to vote at the polls. The decision will put thousands of Florida citizens at risk due to bureaucratic typos that under the 'no-match, no-vote' law will prevent them from voting this November.

- On September 11, 2008 Air America the Tom Hartmann Show received calls from people in swing states who had received "absentee ballot request forms" from the McCain campaign. These were being sent to people registered as Democrats or Independents, but there seemed to be errors in the forms, instructions and/or the return addresses on the envelope for mailing back the forms.

- Also in Ohio, a Republican passed election law could disenfranchise hundreds of thousands of voters. The Democratic Secretary of State describes it as an unconstitutional law that allows Ohio county election boards to cancel a voter's registration solely because some election notices mailed to a home address come back undeliverable.

- In Colorado, Holly Lowder resigned from her post as elections director two months before one of the biggest elections in Colorado history. She held that job since 2006.
Colorado Ethics Watch had been pursuing documents from the state regarding Lowder's ties to John Paulsen whose company installed voter databases in more than 30 counties and recently got two contracts worth almost $184,000 with the secretary of state's office for data work related to the current election season. It turns out Lowder and Paulsen were living together.

- In Virginia, students who are registering to vote for the first time are facing ambiguous new state rules about whether a campus address is sufficient for voter registration purposes. Two weeks ago, in Montgomery County, where Virginia Tech is located, the county election director said students who register to vote in Virginia could no longer be claimed as dependents on their parents' tax returns -- which the Internal Revenue Service later said was incorrect -- and could lose scholarships or coverage under their parents' car and health insurance. Student voting advocates said those remarks were intended to suppress student voting.

There seems to be one reported incidence of the Democrats playing games to suppress Republican voter registration. This September in Ohio the McCain-Palin campaign sent out an absentee ballot request form to approximately one million Republican voters. The form had an unnecessary box where the voter needed to check that he or she was a legitimate voter. The Democratic Secretary of State is reading the law to say that if that box is not checked the voter is not allowed to vote. She has offered to contact people who did not fill out the box but the Republicans find that unacceptable and her reading of the law as too narrow

This is all adding up to a concerted campaign by McCain-Palin to undermine the progress Obama-Biden have made in registering voters. How many hundreds of thousands of voters will be intimidated by these actions, challenged on Election Day or prevented from voting? Will the Republicans be able to de-register voters faster than the Democrats register them?

Voting Machines that are Insecure and Unreliable

This summer there has been a rash of stories acknowledging the faulty nature of electronic voting machines confirming research done since 2003 showing electronic voting cannot be trusted due to the potential for security breach and malfunction.

This summer the Electronic voting machine manufacturer Premier Elections Solutions (formerly Diebold) warned government officials of a critical programming error that can drop votes before they are tallied. Premier's disclosure of an election computer glitch that could drop ballot totals for entire precincts is stirring new worries that an unofficial laboratory testing system failed for years to detect an array of flaws in $1.5 billion worth of voting equipment sold nationwide since 2003. Premier Election Solutions also confirmed that a software glitch in its proprietary systems caused 1,000 votes not to be counted in an Ohio election this March. These problems could have affected election results in 34 states in recent years.

It is not only the Diebold electronic voting system that has problems - they all do. A security review of the Sequoia voting system this summer found serious security and other flaws. Sequoia, along with ES&S voting systems, are the subject of a new paper, and video issued by the Computer Security Group at the University of California, Santa Barbara. The paper clarifies that security is lacking in both Sequoia and ES&S voting systems: "the electronic voting systems that we have reviewed are neither secure nor well-designed."

The Computer Security Group paper also discusses the failure of the certification process which does not and cannot adequately secure a software driven voting system. The failure of certification is also examined by a report this month issued by the GAO which describes numerous instances of problems with voting machines.

In addition to these problems being acknowledged or discovered there have also been a series of voting failures within the last two years demonstrating that the dysfunction of voting machines is not theoretical, but real. Below are some examples:

- Most recently on September 9th the nation's capitol saw a meltdown, D.C. election officials blamed a defective computer memory cartridge for producing what appeared to be thousands of write-in votes that officials say did not exist. In the Republican at-large race, 1,560 write-ins at 9:50 p.m. dwindled to 18 by 12:16 a.m. Thousands of votes were added to individual candidates, inflating vote totals. At 9:50 p.m. 8,246 ballots were recorded in the at-large Republican primary, but that shrank to 3,735 by 12:16 a.m.
The numbers were so bizarre that the malfunction was caught and corrected. But how it happened remains something of a mystery. Sequoia Voting Systems, says that its database and software functioned just fine, and pointed to static electricity or other possibilities.

- In Palm Beach a recount this September 1 found 3,400 fewer votes than the original count. Supervisor of Elections Arthur Anderson is unable to explain the new totals, the Palm Beach County Canvassing Board is showing veteran jurist Richard Wennet leading by just 60 votes. Three weeks after the election the race is still unresolved and last week after looking for missing ballots, the Canvassing Board now has more ballots than were originally counted.

- In Arkansas during an election this spring 45 votes cast in one race were added to the totals of an entirely different race that wasn't even on the same ballot.

- Last year, Volusia County Florida was forced to replace over 300 memory cards on their voting machines due to manufacturing defects.

- Last year, Lawrence County Ohio had one race where the voting machines flipped the results between two candidates due to a programming error.

- In a hotly contested Florida congressional race in 2006, decided by less than 400 votes, 18,000 votes went missing.

Of course, the most serious problem - election fraud - would not be possible to report because it is untraceable and unfindable without a voter verified paper ballot and mandatory audits.

Throughout the country people vote on different kinds of voting systems, usually decided by the county election board. The key battleground states vote on a variety of equipment:

Colorado: Most of Colorado will be voting on a paper ballot-based system with or without touchscreen machines. Next most common will be touchscreens with a paper record.

Florida: Most of Florida will be voting on a mixed system of paperless touchscreen machines and paper ballots. A few counties will be voting on touchscreen machines without a paper record.

Michigan: All of the state will be voting on a paper ballot-based voting system.

Nevada: All of the state will be voting on touchscreens with a voter verified paper record.

New Hampshire: All of the state will be voting on a paper ballot-based voting system.

New Mexico: All of the state will be voting on a paper ballot-based voting system.

Ohio: Most of the state will be voting on a touchscreen system that includes a voter verified paper record. Second most common is a paper-based system counted on an optical scan machine. A handful of counties provide a mix of voting systems.

Pennsylvania: Most of the state will be voting on touchscreen systems without any paper record. The next most common system will be a paper ballot-based voting system. And a handful of counties will be voting on a mixed system of paperless and paper-based voting.

Virginia: Most of the state will be voting on paperless touchscreen voting machines. Some of the state will be voting on touchscreen systems with a voter verified paper record.

Wisconsin: Most of the state will be voting on a paper-based system either with or without touchscreens. The next most common will be a paper ballot-based system. One county mixed systems with and without a paper record.

The challenge with paperless electronic voting is that the machines make mistakes or can be programmed to corrupt the election result, but without a paper record there will be no way to see the corruption. The smoothest election can actually be the most corrupt.

The Good News and What We Can Do

There is an active voting integrity movement in the Untied States. Most of the organizations with a grass roots base are state-based organizations. As a result there are now places where people can get involved in working to make sure their elections have as much integrity as possible. (See links at end of article.)

One thing you can do is tell Congress you want a voter verified paper ballot. You can write Congress by clicking here. This will also get you in the TrueVote.US data base so you can be kept informed of major developments in voting integrity and activism to secure our elections.

Litigation in Ohio is being pursued challenging electronic voting in the most important battleground state in the nation. The RICO suit is based on the testimomy of Karl Rove's IT guru from 2000 until sometime last year, Stephen Spoonamore. The attorneys, Cliff Arnebeck and Bob Fitrakis, intend to depose Karl Rove, Bob Ney and other alleged perpetrators of Republican election fraud.

The Election Assistance Commission has urged all voters to check to make sure they are registered to vote. This is something you should do and urge everyone you know to do. You can register on-line by clicking here. The Obama campaign has set up a web page that allows you to check your registration online. We cannot count on other people to protect our democracy, we need to do it ourselves. You can get the took kit by clicking here. The kit will tell you how we can take back our elections, educate our communities, work with the media, pressure public officials, get public record documents, monitor the testing of voting machines, monitor the voting and the vote count, watch the chain of custody of ballots and audit the election and even file a lawsuit. Thousands of eyes watching makes election theft more difficult.

There are many problems in American democracy - influence of big business money, ballot laws that make independent and third party runs difficult, debates limited to two parties, voting systems that push voters to vote for the lesser evil rather than the greater good, manipulated voting districts to protect incumbents, elections being administered by partisan election officials, to name a few among problems U.S. elections face. But, if we are unable to get these two basic things right - registering voters and counting the vote accurately - then not much else matters because the democracy is a farce and a fraud on the most basic fundamentals.

This year the proportion of voters using touchscreen voting systems - the least reliable system available - is expected to fall to 36 percent in November, down from a high of 44 percent in 2006. In addition, more voters are expected to use paper ballots in 2008 than did back in 2000. Now a majority of voters in the country will vote on paper ballots. Thus, there will be a voting record that will allow for a meaningful audit or recount in many states and counties.

But more work needs to be done. You need to play a role. Democracy is not a spectator sport, but one in which voters must participate - and not by merely voting - but by working to move the United States toward the ideal of the greatest representative democracy on Earth - an ideal that we have nowhere near achieved.

Verified Voting: Mandatory Manual Audits of Voter-Verified Paper Records

The map below shows progress to date in our campaign for verifiable elections. Step 1 of our strategy has been to make sure that there is a paper record of every vote and that voters are able to verify the accuracy of that record before the ballot is cast (that paper record is called a "Voter-Verified Paper Record" or VVPR).

VerifiedVoting.org, our partners, and voters across the country have successfully persuaded the majority of state governments to pass legislation or establish regulations to require VVPR. 31 states, with more than half the U.S. population, now have such a requirement. TrueVote.US is working to end paperless electronic voting in the United States . Touchscreen voting systems are the most expensive and least transparent voting system available where an independent audits and meaningful recounts are impossible. Computerized voting systems have security flaws that undermine the confidence of voters. In addition, they have had Election Day problems – not turning on, or machines freezing or breaking down in mid-vote, candidates not being included, an inability to select the candidate a voter intends and memory cards which store the votes being blank.

The alternative is a paper-based system where the ballot of record is verified by the voter and available for audits and recounts. These ballots can be rapidly counted on an optical scan machine but if they are it is essential that there be a routine audit comparing a certain percentage of the voter verified paper ballot with the op-scan count. This system can include ballot marking devices that enable the disabled to vote independently and cast a secret ballot. These paper-based systems are also less expensive than the paperless e-voting systems.

Advisers said a coalition of community organisations had submitted questionable applications in swing states

Two advisers to John McCain's presidential campaign today said a flood of questionable voter registration applications in swing states threatens to undermine the accuracy of the November election and could prevent legitimate voters from registering for a ballot.

The warning came less than a week after the Democratic party filed a lawsuit in Michigan seeking to end what its lawyers said were Republican efforts to suppress votes of poor people and African Americans, two historically Democratic constituencies. The move indicates the Democratic and Republican parties are set to battle over voter registration in the remaining weeks of the campaign.

On a conference call with reporters this afternoon, former Republican senators John Danforth and Warren Rudman said a coalition of community organisations called Acorn had in several states submitted voter registration applications for people who were already registered.

The senators did not accuse the group of fraud, but suggested the group's registration drive was "diluting" legitimate votes and causing havoc in the nation's voter registration process.

"Our mission is to ensure that everybody who is entitled to vote gets to vote without any intimidation but also that there's no stuffing of the ballot boxes, no fraudulent voting and also that the rules are the same for everybody," said Danforth, a former Missouri senator.

"We are concerned that there is or may be a pattern of registering people who are not entitled to vote or otherwise gumming up the system for registering voters."

He cited news reports in Michigan, Colorado and elsewhere describing problematic registration applications surfacing after large Acorn registration drives. Earlier this month in Detroit, for example, the secretary of state's office cited a "sizeable number of duplicate and fraudulent applications" arising from an Acorn drive.

Last week, Republican officials called Acorn's North Carolina chapter "a quasi-criminal, Democratic affiliated organisation" after an election official asked the state to check 80 applications submitted by the group.

Today, Danforth sought to link Acorn to the Obama camp, noting that a political action committee affiliated with Acorn endorsed Obama.

He also said the McCain campaign was concerned that some ballot stations in heavily Democratic areas would be allowed to remain open on election night after their scheduled closing.

State laws typically allow that anyone on line to vote when the polls are scheduled to close may cast a ballot, but Danforth said he was concerned polling sites would be kept open to accommodate Democrats' late voter turnout efforts.

Rudman defended the party against Democratic allegations in Michigan that Republicans are working to deny the vote to people who lost their homes in the mortgage crisis.

The Democratic party said its lawsuit filed last week in Michigan was aimed at ceasing the practice. The suit came after a Macomb county Republican official told a local newspaper the party was culling voter names from foreclosure lists to challenge their residency.

Rudman said the suit was a "red herring", and that, "all the local officials deny it". He called on the Democratic party to come to an accord with the Republicans on election-day procedures such as extended polling hours.

The back-and-forth between the Democratic and Republican parties reflects the historic divergence between the two camps on voter registration and ballot access. The Republican party has typically pushed for strong verification requirements, such as identification checks at the ballot, measures they say are intended to counter voter fraud.

The Democrats, meanwhile, say such strictures will discourage the elderly and poor from voting. Non-partisan election experts say there is minimal fraud in US voting.

mybaracobama.com and left a link to this thread with a question regarding what the campaign is doing about this. then it struck me that bobby kennedy jr is probably in direct contact with barack himself. he and members of his family know all these people. they should be able to get something going to fix this. why wouldn't they? after the last two elections you'd think they'd be too smart to just ignore it.
last week i followed another link fully intending to donate to his and greg palast's campaign to stop election fraud and the link was bad. on barack's page i did a search on the "answers" page for this issue; it wasn't there. i feel helpless.
when all is said is done this law must be repealed, and those denied their right to vote should bring a class action suit to make sure of it. it is fucking unamerican to deny citizens their vote.

Don't freak out, I'm not saying Obama will lose. Obama will almost certainly win.

But does that mean he will be president? I'm skeptical.

TAMPA, Fla. - Voters cast their ballots in a razor-close election, and opponents head to court as a judge approves another recount.

Welcome back to Palm Beach County, where the more things change, the more they stay the same.

With 41 days to go before the presidential election, election officials and political operatives in this heavily populated Florida county — famous for overvotes, undervotes, butterfly ballots and hanging chads — are worried about a repeat performance of the chaos that clouded the outcome of the 2000 presidential race.

Two recounts, and counting
Those concerns have been fueled by an otherwise obscure local judge’s race.

County Circuit Judge Richard Wennet faced a strong challenge from William Abramson, a local criminal lawyer, last month. When the ballots were counted, Abramson led by 17 votes out of more than 102,000.

An automatic recount was conducted, which put Wennet ahead by 60 votes. But this time, about 3,500 ballots were missing. The state elections board refused to accept the result.

Off to court they went. A state judge ordered another tally. No result was announced because, while the missing 3,500 votes were found in a warehouse, a fresh batch of 159 that were counted the first time could not be read.

Another machine recount was conducted Tuesday. It said Abramson won, but the machines kicked out 160 ballots they could not read. After those were counted by hand, the county canvassing board declared Abramson the winner. However, Wennet said he might continue the fight.

This back-and-forth has some fearing far worse in November.

‘We could have major problems’
“We have seen problems in Palm Beach County already in the primary,” said Ben Wilcox, executive director of Common Cause Florida, a watchdog group. “I think potentially we could have major problems in Florida again.”

It’s not like they didn’t try to fix things after the electoral meltdown that sent the 2000 election all the way to the United States Supreme Court.

The punch cards are gone. Security cameras monitor all activity in every county election office. Random spot-checks review each ballot in 2 percent of all precincts.

But the “improved” system may not be much better than the old one.

“There’s a lot of improvement needed here and throughout the state of Florida,” said Judge Barry Cohen, chairman of the Palm Beach County Canvassing Board.

For example, to ensure that each voter is properly qualified to vote, the state imposed stringent ID requirements. The rules say a voter’s driver’s license or approved alternative identification must match up exactly with the voter database.

Two problems: Some driver’s licenses have typos. And the voter rolls have never been proofread for errors.

“Requiring to be matched up perfectly to databases which have never been tested for accuracy is simply a prescription to have people disenfranchised,” said Ion Sancho, elections supervisor in Leon County, the location of the state capital, Tallahassee.

85. Many of them are old and are threatened by the new Dems on the block
They don't want change and are afraid of change. There is a rift between the old party people who have had control and are now afraid of this new Obama crown coming in. Where I live they actually seem to be discouraging us. It is sad and they are weak people who want to keep the status quo.

which has been THE mystery of the past eight years . . . either the Democrats . . .

a) don't believe that election fraud is taking place -- in which case they're idiots . . . or . . .

b) know that election fraud is taking place, and don't care -- in which case they're idiots AND traitors . . . or . . .

c) know that election fraud is taking place, and someone or something is intimidating them so severely that they are unwilling or unable to do anything about it . . . in which case we're in a hell of a lot more trouble than we even imagined . . .

are there any options I've missed? . . . probably . . . but these are the three that jumped out at me . . . and, frankly, I'm not sure which of the three is most depressing . . .
