Lawyers: 2 Marines won't testify in federal trial

RIVERSIDE, Calif.—Attorneys for two Marines have told a judge their clients will not testify during the trial of a former squad leader.

U.S. District Judge Stephen Larson is considering what possible action to take against the two Marines -- Sgt. Ryan Weemer and Sgt. Jermaine Nelson. They were previously jailed twice for refusing to testify before a federal grand jury looking into allegations that Jose Luis Nazario Jr. shot and killed unarmed detainees in November 2004 in Fallujah, Iraq.

Larson says their refusal to testify could expose them to federal criminal contempt charges.

It's the latest development in a first-of-its-kind federal trial in which a civilian jury will decide whether the alleged actions of a former service member in combat violated the rules of engagement.

You wanna compel testimony, you'd better avail yourself of sterner methods in George W. Bush's America. Nice to see that Bush administration ethics prevail in his military, as well.
