If he's relying on a pardon then he won't. But in 2 years Bush's pardon power will run out and presumably further charges could be brought against him as well as the rest of the cabal at some point.

Let's say Bush pardons Libby, and lets further say that the Dems get an investigation going in Congress.

Well, since Libby is pardoned, then that means that he has no legal reason (i.e. the "5th") not to talk. If he shuts up, then he can be charged with Contempt of Congress.

But if Bush DOESN'T pardon Libby, then when testifying before said Congressional Committee, he's opening himself up to a bunch more jail time.

The trick will be to put Libby back into legal jeopardy in such a way that he is force to create a new nickname - "Squealer".

I'm more interested if some Democratic Congress-critters are speaking to Fitz, rather than how Libby is trying to reduce the current amount of time he's facing.

Well, since Libby is pardoned, then that means that he has no legal reason (i.e. the "5th") not to talk. If he shuts up, then he can be charged with Contempt of Congress.

Whether Libby's pardoned or not, he can be forced to testify. If he's pardoned, he no longer has 5th Amendment protection, and thus can be forced to sing, or perjure himself again. If he isn't pardoned, then Fitz or Congress can lean on him with his conviction, threaten him with hundreds of thousands of dollars of fines, legal fees, etc, and of course, prison time, then offer him immunity and a light sentence if he sings.

So I'm not surprised that Cheney's developed "health problems."

*how long he can stay out on appeal in effect running out the clock on the Bush "administration" so Bush can pardon him on his last day or so and...

*how much he trusts that Bush will in fact pardon him

if he doesn't trust Bush and likely will go to prison while the appeals proceed, I think he'll sing like a bird. He'll feel he was thrown under the bus.

Of course, if he fears for his life if he sings which he legitimately should, he's just going to prison.
