just listened to Oxy a few minutes...he is spinning spinning spinning
it is really funny

he is saying an appeal will be given based on the questions the jury asked because it made no sense

1. EVERY jury wonders about "reasonable doubt"
because both state and federal jury instructions on that issue suck. But they are better than any alternative. I will dig up an example and post it later. A lot, and i mean a hell of a lot, of time and brainpower went into creating, editing and finalizing that jury instruction. And it can be confusing to the layperson.

He's not a lawyer.

I've helped draft and type many hundreds of jury charges, including definitions.
All criminal jury charges have to be custom crafted according to the facts of the case, and the definitions of crimes and beyond a reasonable doubt, and such. They MUST be extremely clear. The definition of "beyond a reasonable doubt" is one of the few legal terms that does not have a strict definition.


I know this because I have a law degree and I was a court reporter for nearly twenty years.

And don't forget that in the civil case, the burden of proof is lighter. The burden of proof in civil cases is "preponderance of the evidence".
That means "50 percent plus some microscopic fraction, or more".
