Today is Your Last Chance To Speak Out To Save Our Media From The FCC
This coming Tuesday, December 11, is the LAST day to send your
comments to the FCC, opposing the move of the right wing operative
Chairman Kevin J. Martin to remove the last restrictions from a total
mogul takeover of every newspaper, radio and television station in
the country.

This is a fight we can win, just exactly as we did in 2003 against
his predecessor, the equally compromised Michael Powell, but only if
you speak out now, and join the upwards of 20,000 of our participants
who already have in response to this call to action.


Friends, we are still working to get this alert going at 2 AM in the
morning, because it is that important that we get every possible
voice to speak out now. We need your voice. There are some issues
where we need to pull out all the stops and get maximum
participation, not only because the issue is critical, but because
victory is within reach if we do. This is one of those issues.

The action page above will send your personal message not only to all
five of the FCC commissioners, but to all your members of Congress as
well, who are already working at their end to stop this rash proposed
giveaway by passing the Media Ownership Act of 2007. There is strong
bipartisan support for this bill, but they need your support to make
this legislation actually happen.

9. I saw Michael Copps (FCC commish) speak at a media forum in May 2003
and it was public outcry which prevented this from happening four years ago...we can make a difference.

Thursday Code Pink held a rally and action at the Federal Communications Commission to protest its impedending lifting of caps on media ownership. Their action took place at the FCC's final public meeting ahead of the scheduled June 2nd vote to formally overhaul its regulations on media ownership. The proposed rules would dramatically increase the concentration in corporate ownership of the media, removing caps on the percentage of television market nationally and locally that can be owned by one company, and lift the television / newspaper cross ownership ban.

During the meeting Code Pink interupted the proceedings with a plea to the FCC commissioners to not adopt the proposed rules. A banner was also unfurled demanding "Public Interest Not Corporate Profit" and a pink slip, Code Pink's trademark scold, was on hand for FCC Chair Michael Powell. more

My letter:

TO ALL THOSE ADDRESSED and TO WHOM IT MAY CONCERN:

I am aware that Mr. Kevin J. Martin, with little advance legal notice to the public, on November 9th, tried to push through a policy gutting the current FCC media ownership rules by December 11. Though a thousand protesting voices were present, Mr. Martin turned a deaf ear to them. Mr. Martin is obviously trying to pull a fast one and he needs to be stopped from such dangerous shenanigans.

S.2332 would do just that. It would require a full NINETY DAYS of public notice and comment time on any such proposed media ownership changes. It would also require protections for localism and DIVERSITY of ownership, including female and minority ownership.

I FULLY EXPECT my representatives in the Senate and Congress to SUPPORT S.2332 and I WILL BE watching their votes on this.

I ALSO EXPECT THE FCC to have more integrity than to let the likes of Mr. Martin shove his own media ownership rules through that agency - with little public notice - while ignoring public outcry.

What Mr. Martin has attempted is a dictatorial, self-serving, slimy, arrogant stunt. Please see that it doesn't happen again. You can do that by supporting S.2332.

Actually two questions:

Does anyone know if this is revockable, either by Congressional action later or by a new FCC under a democratic president?

I think Martin will push this through the FCC no matter what. The real issue is getting Congress to slap it down.

The Telecommunications Act of 1996 set the modern tone of "deregulation," a relaxing of percentage constrictions that solidified the previous history of privatizing the utility and commodifying the spectrum. The legislation, touted as a step that would foster competition, actually resulted in the subsequent mergers of several large companies, a trend which still continues.<2>

The FCC held one official forum, February 27, 2003, in Richmond, Virginia in response to public pressures to allow for more input on the issue of elimination of media ownership limits. Some complain that more than one forum was needed.

On June 2, 2003, FCC, in a 3-2 vote under Chairman Michael Powell, approved new media ownership laws that removed many of the restrictions previously imposed to limit ownership of media within a local area. The changes were not, as is customarily done, made available to the public for a comment period.


* Single-company ownership of media in a given market is now permitted up to 45% (formerly 35%, up from 25% in 1985) of that market.

* Restrictions on newspaper and TV station ownership in the same market were removed.

* All TV channels, magazines, newspapers, cable, and Internet services are now counted, weighted based on people's average tendency to find news on that medium. At the same time, whether a channel actually contains news is no longer considered in counting the percentage of a medium owned by one owner.

* Previous requirements for periodic review of license have been changed. Licenses are no longer reviewed for "public-interest" considerations.


The decision by the FCC was overturned by the U.S. Third Circuit Court of Appeals in the decision Prometheus Radio Project v. FCC in June, 2004. The Majority ruled 2-1 against the FCC and ordered the Commission to reconfigure how it justified raising ownership limits. The Supreme Court later turned down an appeal, so the ruling stands.

If you don't much use one, try the other. They seem to attract opposite aesthetics. :)
