Update On Michigan Call for Legal Aid by Demeter

This morning, after a rather sleepless night, I have done the following:

I have petitioned for a restraining order against the neighbor who I believe has filed the anonymous and groundless complaint that my daughter is in imminent peril of her life.

I have verified that no action has occurred in Probate Court. But Adult Protective Services is a state agency.

I now know that the anonymous complaint claims to have 3 witnesses of my fighting with my daughter.(!) My daughter outweighs me by 100 lbs, and has 5 inches on me. The Mental Health people observed bruises. My daughter is known to inflict bruises on herself in a tantrum by pounding on whatever makes the most noise with her fists, not an unexpected event in the autistic person's life, and she is also extremely clumsy on a daily basis due to motor deficits, when she isn't otherwise enraged.

The school people are dumbfounded. As people on the scene every week, they would be the first to notice. And they have observed all the above behaviors, experienced them themselves.

The Advocates say that APS has the right to take her. I have the right to a hearing, and expenses thereto.

1. have you gotten anything in writing? have you checked local police logs?

When I called the local police to find out the history of the undisclosed to me former meth lab house my call showed up on the event log pdf file via a google search.

So I would make a call and/or go down to the police station to view a record of calls.

Also did APS give you the "alleged complaint" in writing? Have they given you anything in writing?

If you sue on grounds of the neighbor filing a false complaint will you be able to sue him for the cost of attorney fees to defend yourself from the bogus charges?

It's a new situation, but I'm sure my previous experiences with the Nanny State will serve me well.
