North County Times: Kontogiannis lawyer says Cunningham briber is too sick for prison.

... Kontogiannis pleaded guilty in February to one count of money laundering for using his family's mortgage company to channel more than $1 million in bribes to pay off Cunningham's lavish Rancho Santa Fe estate in 2003.

The businessman, in his pledge to cooperate with the government, has also admitted to as much as $100 million in mortgage fraud unrelated to the Cunningham case, according to the newly filed court documents.

But Kontogiannis -- who has been charged with bribery three times in the last 14 years -- has a grave heart condition, his attorneys argued in the documents. They asked the court to postpone the sentencing so their client can have bypass surgery. ...

Kontogiannis' defense attorneys, in a separate court filing, argued to the judge that the fraud admissions cannot be used against Kontogiannis in his sentencing, because Kontogiannis told federal agents about the $100 million in fraud as part of his deal to cooperate.

2. I have a friend who's a NYC court officer ...
He told me about an incident a few years back where a defendant was sentenced to eighteen years in prison (for a list of offences, including extortion, money laundering, loan sharking, drug dealing, etc.)

The defendant's lawyer pleaded with the judge to waive the prison time:
"My client is very sick, Your Honor. He has diabetes, hepatitis II, and a bad heart. He'll never live long enough to serve eighteen years."

The judge responded that he understood the defendant's predicament. "You're right," he said to the lawyer. "Under the circumstances, your client probably won't last eighteen years behind bars. All the court can do is ask that he use best efforts to serve out the full sentence."

3. Hmm... Are we going to see another "Ken Lay" situation?...
And perhaps instead of having a more "public" unconventional "vacation" in Europe without a passport under the "guidance" of some hidden federal agency unbeknownst to the courts, this time around he'll seem dead but in fact be someplace else taking another vacation where noone will be able to find him! Just wait and see. He's setting it up with this report now!
