Federal Contractors Could Be Forced to Self-Report Crimes

The Justice Department has proposed tough new regulations for those who do business with the government, a reflection of the growing number of fraud, bribery and waste cases arising from the multibillion-dollar federal procurement process, say industry experts and regulators.

The new rules would require federal contractors to report themselves if any of their employees -- or subcontractors -- violate a criminal law related to a contract worth more than $5 million while that work is being done. If a contractor is caught not reporting its violations, it could be suspended or barred from doing business with the government for up to three years.

"This is a sea change in federal procurement law," said Peter S. Spivack, a partner at the law firm Hogan & Hartson who specializes in defending government contractors. "It requires contractors to turn themselves in if they believe someone committed fraud, for example, in doing a contract."

And the businesses volunteered to not comply.

U.S. joins lawsuit against Lockheed Martin

The U.S. government says the defense contractor overcharged it by millions of dollars, joins whistleblower lawsuit.

The U.S. government has joined a whistleblower lawsuit that alleges defense contractor Lockheed Martin Corp., vendor Tools & Metals Inc. and former executives of TMI overcharged the government by millions of dollars, the U.S. Department of Justice said Monday.

The lawsuit filed by a former TMI account executive and a TMI competitor alleges that former TMI President and Chief Executive Todd Loftis overcharged for manufacturing tools sold to Lockheed Martin, which resulted in Lockheed Martin submitting false claims to the Defense Department from January 1998 through February 2006.

The Justice Department said the complaint alleges that Lockheed is "independently liable" for TMI's violation of the False Claims Act due to its "reckless oversight of TMI."


It seems there is a monthly news story about Lockheed overcharging the government.
