Schumer (Still) Sticking With Mukasey

Chuck Schumer just released the following statement reasserting his support for Michael Mukasey's nomination for attorney general.

"I will support Judge Michael Mukasey for Attorney General.

I have spent the last nine months doing everything I can to get new leadership at the Department of Justice and I believe the job will not be finished until we get a strong and independent Attorney General. I believe Judge Mukasey is that type of person. Should we reject him, it is almost certain that an acting, caretaker Attorney General will take office without the advice and consent of the Senate. Inevitably, that would enable those in this administration, who do not believe in the rule of law, and have done things that caused even former Attorney General Ashcroft to threaten resignation, to have the complete upper hand.

I would also like to say something about torture, particularly waterboarding. I deeply oppose it. I supported Senator Kennedy's amendment in 2006 and am a co-sponsor of his bill in this congress. Unfortunately, this nominee, indeed any proposed by President Bush will not agree with this. I am, however, confident that this nominee would enforce a law that bans waterboarding as I hope it will.

This afternoon, I met with Judge Michael Mukasey one more time. I requested the meeting to address, in person, some of my concerns. The Judge made clear to me that, were Congress to pass a law banning certain interrogation techniques, we would clearly be acting within our constitutional authority. And he flatly told me that the President would have absolutely no legal authority to ignore such a law, not even under some theory of inherent authority under Article II of the Constitution. He also pledged to enforce such a law and repeated his willingness to leave office rather than participate in a violation of law.

"Are you running for re-election in 2008, Senator? Because if you are, you better start kissing major butt now.

Your vote for Mukasey is an unforgivable slap in the face of every Constituent who supports you, supported you and planned to support you in the future. With this vote, you not only bend over for Bush -- again -- and give one of the worst Presidents in History yet another enabler to shred the Constitution, you help install a man who couldn't give a clear answer on whether or not one of the most heinous of acts is, in fact, torture! Is that the kind of Senator I want representing me? Hell no!

I've never gone to the Polls on Election Day and NOT voted for one of the offices. But in November 2008, I will not be pulling the lever in your favor. Better to have a No Vote in the Senate column that to hold my nose, again, and vote for the likes of you. I'm disillusioned, disappointed and feel lied to.

Not that you give a shit -- I am, after all, only one of the Constituents you swore to Represent --, but at least some lowly intern will read this and delete it."

And I'm shocked that Schumer would actually believe Mukasy's lies about respecting Congress and blah blah blah. Gee, do you think he's weasling around just to get confirmed, Chuck, and then will do whatever the hell he wants regardless of what you or anyone else thinks?

2. Senator, I don't a fuck what your excuse is....by voting for the SOB, you, in fact, support TORTURE
Mukasey has not responded with anything to dispute torture, to say he is against w/b, to clarify his position...This is a slap in the face to Americans who believe w.b ing is fucking torture.

By supporting him...you, sir, are indicating Torture is OK w you.

Your Credibility is now shit
