Florida: Court has lethal-injection fears
State justices express doubts about the scheduled execution of a Brevard killer.

Florida Supreme Court justices said Thursday that they are wary of proceeding with next month's scheduled execution of convicted Brevard County child-killer Mark Dean Schwab with the legality of lethal injection now in question.

The U.S. Supreme Court last month agreed to consider the constitutionality of lethal injection after two condemned Kentucky inmates said that state's procedure -- identical to what's used in Florida -- represents cruel and unusual punishment.

Notice the writer's usage of "killer"? Delma Shaw, a Texas death row inmate, has been strapped to the gurney over 14 times. Each time the headlines called him a "killer" too.

Yet, the Supreme Court has stayed his execution 14 TIMES. The death penalty in America is not merely flawed; it is broken and beyond repair and one cannot help but wonder, how do reasonable people sleep at night knowing this to be true.

1. Put him in jail and throw away the key
Let him spend the rest of his natural life incarcerated and thinking about what he did. Yes, being strapped to a gurney 14 times IS cruel and unusual punishment.

In the case of Delma Banks, the Supreme Court overturned Texas's death sentence saying the prosecution withheld evidence that might have kept jurors from imposing the death penalty.

The nightmare for Delma Banks, his family, the victims family, and death penalty opponents, there was strong evidence that Delma Banks was innocent. His case clearly shows that ALL involved was on a roller coaster for more than 20 years.
