It's incredible how weak the dems are behaving. They're still the minority party! The new rules say that unless the dems have 61 seats in the Senate, they're in the minority. For the gop, only 40 seats are required to form a majority. I couldn't explain how all this works exactly, but you can always ask Harry Reid. He seems to understand.

Your theory about the Dems needing 61 seats is correct, but that's only because the GOP firewall blocks everything. Call it weakness if you want, it's certainly an arguable point but I tend to place the blame where it's most deserved, on the GOP who are acting like spoiled brats.
