Michael Isikoff writes in Newsweek with an important point: If Libby's lawyers want Cheney to testify, they'd better act quick.

Cheney "is due to leave the country for a 10-day trip to Asia on Feb. 19.

Now isn't this convenient?

This White House has rushed people overseas to avoid testifying before. Should work for Uncle Dick. I just wonder if team Libby will be able to get this nugget of information to the Jury, that they wanted to call Uncle Dick but he had to leave the country.

18. Actually, there might be a problem with the 10 day recess
Patrick Fitzgerald has another trial starting very shortly in Chicago, namely Lord Black's. It should offer some serious fireworks. I wonder if they'd have to get a continuance to wait around for Crashcart.

In the meantime, H2O Man said on another thread that if he's appearing, it'll be Thursday.

20. This is where the unitary executive theory & separations of powers arguments rise....
will be up to the courts to decide what course of action must be taken to obtain his compliance(ie. postpone trial, etc) and it is a toss up whether the Executive Branch will bow to the will of the Judicial Branch in a 'small' criminal case involving an individual.
