Texas defies federal court with plan to execute man who did not kill

The Guardian

Texas is poised to execute a man for a crime he did not commit. While the perpetrator of the murder in San Antonio was executed last year, Kenneth Foster, who was sitting in a car 25 metres away at the time of the shooting, was sentenced to death under the "law of parties".

The controversial Texas law removes the distinction between the principal actor and accomplice in a crime, and makes a person guilty if they "should have anticipated" the crime.

even on such advice.."

So in 16 years, or more, there hasn't been one mistake on death row according to Bush & Perry. Not one legal error, evidence error, extenuating circumstance, reasonable doubt, nothing. Hundreds of people marched to their death, and not given a hint of possibility that a mistake might have been made. Incredible.

I guess this guy's going to die, considering they don't even appear to care about federal court either.

2. Perry has no such authority
the only thing the Gov. can do
is offer a 30 day 'stay',

other authority belongs to the Parole Board.
