Let me tell you something about the "man"....
I have had a recent tragedy in my family.

I cannot go into details. But I will tell you it is hairy.

Very, very close family members have been remanded and are being held at 1,000,000.00 bail a piece. They have done nothing illegal.

Their assets have been frozen and they have been cut off at the knees. They are unable to provide themselves a defense. They have been assigned public defenders, and private attorneys.

I have kept this to myself for over a month for fear of communicating on the internet regarding their situation.

They are in serious legal jeopardy. Although they have no backrounds of ever breaking the law.

The investigative entity that went before a judge and received a warrant and an unexplainable bail amount have lied, distorted, and used illegal means.

I feel really helpless.

2. I hate to ask
but do you have a link for this? Aren't arrests and trials matters of public record. If it's part of the war on Tara, I would think Bushco would be bragging about these terrarists that he'd caught. If the media is not reporting it, they should be. If it was me, I would not keep quiet about it. I would broadcast it on every medium willing to listen. I would contact every elected official I could think of from my city council person to state legislators to attorneys general to governors, senators, Presidents, etc.

Might not do a tanj bit of good, but I'd sure as heck try, unless our lawyer advised against it.

3. Sorry...
I can't say a word. It is on advisement.

But it is a horrible injustice.

8. I spoke to one today
I informed him I had many documents for him. He told me NOT to mail them but to bring them to him. He is very distrustful. He also told me not to speak over the phone or during visits regarding the case.

The public defender that was assigned to the other defendant is on vacation until the end of the month. However, I have been told by outside attorneys that he is a very smart lawyer, has had many capital cases, and would be able to help. IF he was kept on the case.

This is a very complex case with thousands of documents. The state may not be able to keep the case and may have to assign it to outside counsel.

10. So it means this could drag on for a long time
being a huge drain on emotions and finances.

But at least there is hope in that the attorneys appear to be qualified.

I will keep my fingers crossed for you. What must make it worse is that you cannot talk about it. Talking always seems to help.

And please ignore the rude gnat who is buzzing around the thread. You do not need those such as him bothering you at this time. That poster is a boil on the butt of humanity.

15. Are they losing the house, or are you just shutting it down
because of a potential long confinement while waiting for trial?

It is good that they have a close relative on the outside that they can count on to help them with all the stuff that must be done. Hopefully there are no underaged children involved who are losing their parents presence.

All this stuff must seem other worldly to you.

They have a rental. I have no money to pay their bills. I am moving their things into storage. It has devastated my life.

We are barely paying our own bills let alone having to take over this huge responsibility. I am packing belongings and placing them in storage. I don't know how we are going to do it.

It is a nightmare.

19. It may be a good idea if you edit
that subject line out. Just to be safe.

I kinda figured that was the relationship by the sense of worry I felt in your posts. I am so sorry about this happening to you and yours.

22. First of all I am a girl.
Second of all I have been around for a long time. DUers know who I am.

Everyone here is very aware of unlawful detention, cops that lie and fabricate evidence, judges that are bought and paid for, and all of the other rampant corruption that is present in our justice system.

One only need to look upon our country's chief legal officer to determine the unlawfulness of our system.

If you don't think cops lie, prosecutors lie, and judges make decisions based on political outcomes. You are late to the party.

13. you obviously don't know what you are talking about
So you don't know how certain counties are taxed with overloads of criminal defendants. The ones that they can shuffle through are well...shuffled through. Because of the dynamics of this case, the PD and APD will not be able to handle it because of the enormous amount of documents related to discovery and all of the motions that will be necessary. Therefore the county will have to assign the one defendant who was assigned a PD, a private attorney who will be able to handle the multitude of discovery that is necessary in this case.

The downside of all of this is; this case will take at least a year to even prepare for a trial. That means that the innocent people that are sitting in jail will remain there until the case is either dismissed or charges are dropped and there is a change is circumstances that would warrant another bail hearing.

Your knowledge of the the law, as well as economic indicators is lacking.

14. Not funny.
Vick is a free man. His assets have not been frozen. He has been afforded a more than adequate defense. But see, he is guilty. He is going to plea to conspiracy to avoid the more serious charges.

You can't compare the two.

23. Lying prosecutors, especially if they do it out in the public, haven't
done well, lately. Any way you can easily expose their lies and report it in a public manner? Like a letter to the editor?

24. Our Constitution's first establishment is JUSTICE.
We seem to have wandered: to the dogmatism of "the rule of law," now blatantly to plain old power and money.

Our public defenders should display noblesse oblige, instead display neither nobility nor obligation to duty, people, constitution or their own souls.

BUT, justice remains written on each of our hearts and through the processes of involving more people like the lawyers, judges and juries the truth touches an uncalloused heart and finds path into others. No matter how battered our nation's cornerstone might appear, we still trust in each other, and that is a well placed trust.

Now is the time to dot your i's and cross your t's. Make those defenders sign each and every overly onerous assertion, personally if they go beyond the scope of their position. And, realize it is a battle worth fighting, a war, with ourselves, with hearts uncalloused pitted against those calloused. A fight that if we don't win, then it is democracy itself that lies in question.

For that I wish you and your family wild success.
