Salinas child molester avoids prison, gets probation
A former Little League coach who pleaded no contest to child molestation charges avoided a prison sentence and was placed on probation, outraging the family of one of the victims.

Superior Court Judge Richard Curtis said Thursday he believed David Martin, 42, was truly remorseful and could be rehabilitated with therapy. He gave Martin credit for time served and placed him on five years' probation.

Curtis had imposed an eight-year prison sentence but suspended it pending successful completion of probation. The judge warned Martin he would be sent to prison if he violated probation.

Oh, so he's remorseful is he? He'll never change, never. Idiot judge. I'm sick and tired of these child molestors not serving time in jail.

3. It's unpopular to say
but the recidivism rate of sex offenders is pretty low, compared to other crimes. It simply isn't true that all sex offenders will repeat their crimes.

5. Huh? Really? I thought it was high?
I'm torn on this issue. I would rather see these people receive intensive treatment so they aren't put back on the street to do it again. But they should serve SOME time! Perhaps in special prisons set up for intensive therapy.

one meta-study concluded

"Evidence from 61 follow-up studies was examined to identify the factors most strongly related to recidivism among sexual offenders. On average, the sexual offense recidivism rate was low (13.4%; n = 23.393). There were, however, subgroups of offenders who recidivated at high rates. Sexual offense recidivism was best predicted by measures of sexual deviancy (e.g., deviant sexual preferences, prior sexual offenses) and, to a lesser extent, by general criminological factors (e.g., age, total prior offenses). Those offenders who failed to complete treatment were at higher risk for reoffending than those who completed treatment. The predictors of nonsexual violent recidivism and general (any) recidivism were similar to those predictors found among nonsexual criminals (e.g., prior violent offenses, age, juvenile delinquency). Our results suggest that applied risk assessments of sexual offenders should consider separately the offender's risk for sexual and nonsexual recidivism."

The US Bureau of Justice Statistics, in a three year study, concluded:

Highlights include the following:


Released prisoners with the highest rearrest rates were robbers (70.2%), burglars (74.0%), larcenists (74.6%), motor vehicle thieves (78.8%), those in prison for possessing or selling stolen property (77.4%), and those in prison for possessing, using, or selling illegal weapons (70.2%).

Within 3 years, 2.5% of released rapists were arrested for another rape, and 1.2% of those who had served time for homicide were arrested for homicide.

7. They need to be able to identify the sub-groups most likely to repeat as offenders.
Those sub-groups identified as likely to repeat should be restricted as to where they can live.

But those that can be identified as not likely to repeat should not be labeled as sex offenders. At the same time the arrest records should not be expunged to prevent access to their past criminal record.
