Cheney makes a BIG mistake - Says his office is not part of the Executive Branch
You've got to remember, you can't have Executive Privilege if you aren't even part of the Executive Branch.

It's time for Democrats to turn their sights toward Cheney and investigate anything they can.

9. You have to remember, he's not very bright.
None of these guys are rocket scientists. Evil does not necessarily equate to genius.

2. not article 1, not article 2, not article 3?
But SECTION 1 of Article 2 mentions the VP while outlining the powers of the executive. It also says the VP takes over if P becomes incapacitiated.

The only other place that the VP is mentioned is in the last section of Art. 2 talking about impeachment.

VP also mentioned in Art 1 to break ties. NOWHERE in the constitution does it say the VP is in office to break laws, though.

3. Originally the VP did not run as VP
Everyone ran for President and the 2nd place person became VP

5. The Vice President is the President of the Senate.
Edited on Thu Jun-21-07 10:48 AM by originalpckelly
This is the reason that the VP sits up there with the Speaker of the House when the President gives the SOTU speech.

If there is one major flaw in our system, it is the office of the VP, and I believe that's why Cheney targeted that office to exploit this flaw in the US Constitution so that he could gain power.

It is the most prominent exception to the separation of powers doctrine.

4. Actually, neither the Presidency nor Vice Presidency are part of
the Executive branch anymore, but the newly created emperor branch of the government. There was a good line in the recently ended HBO series "Rome". When Octavian solidifies his position as dictator, he decides to call himself "First Citizen". His mother turns around and tells him, he's king now.

7. constitutionally, he's essentially correct.
he's really just the president of the senate, which entitles him to nothing beyond breaking ties.

which also means that from an executive standpoint, no one should listen to him. this is why one former veep said that the office "wasn't worth a bucket of warm spit".

at least, that's the quote the way the papers ran it. my guess is that is was editted ever so slightly

11. It's The Administrative Branch!
At least, that's what * called it.

And that was Texan John Nance Garner who said "it wasn't worth a bucket of warm piss." Colorful guys, these Texans.

16. if he's nothing more than "president of the Senate"
doesn't he have to abide by rules of conduct, ethics etc of the Senate?

what's the process to censure or impeach or otherwise discipline a "fellow" member of the senate?

and guess what - executive privilege doesn't apply if he's not part of the executive branch... can we smell the supoena now?

13. He could merely be informing us of how it's gonna be from now on.
And implicitly asking "So what are you gonna do about it?"

He knows the answer to that one.

14. What's next for Dick Cheney?
Will this a-hole declare that he's officially a Chilean flap-wing fruit bat--thereby exempting
him from any legal and moral responsibility to this country and its citizens?

"I can't be held accountable! Look at me! I'm a bat! Plus, I'm nocturnal and you can't prove
that I was awake during the day--when the illegal schemes were played out! Eeeeee! Eeeeeee!".

24. When it comes to subpoenas and testifying, he'll suddenly have executive privilege
and be part of the executive branch, but when it comes to obeying laws that apply to the executive branch, he's not part of the executive branch. Would anyone be surprised if that's what he eventually claims? At least, I'm sure his lawyers are capable of talking out of two sides of their mouths at the same time, don't you think? Actually, Cheney is claiming that whatever HE says the law is, that's what the law is. He's above all branches of government and is whatever he defines himself to be. Maybe he should be proclaimed a god?
