Libby draws conservative appellate panel


"Libby's request was assigned to Judges David B. Sentelle, Karen Lecraft Henderson and David Tatel of the U.S. Court of Appeals for the District of Columbia Circuit. Sentelle was put on the bench by President Reagan, Henderson by the first President Bush and Tatel by President Clinton."

"David B. Sentelle conspired with Senators Jesse Helms and Lauch Faircloth to remove Robert B. Fiske Jr. as independent counsel and replace him with Kenneth W. Starr, a right-wing Clinton-hater ..."


How the Big Ones Got Away

"One of Walsh's chief purposes in ''Firewall'' is to answer the questions that his many critics have raised about his prosecutions. The first is whether he botched the cases against North and Poindexter. Walsh blames Congress for rushing into hearings before he could complete his investigation. And he blames the conservative United States District Court judges David B. Sentelle (who appointed the current Whitewater prosecutor, Kenneth Starr) and Laurence H. Silberman for overturning North's and Poindexter's convictions on grounds that would make it ''essentially impossible to prosecute anyone who had received Congressional immunity.'' "


Iran-Contra Precedent

"On the North appeal in 1990, Silberman teamed up with a younger conservative, Judge David Sentelle, to overturn the three felony counts against North. The vote was 2-1.

Ironically, in ruling for North, the two law-and-order judges chose to expand the rights of defendants in cases involving limited immunity, such as that which Congress had granted to North.

Sentelle, a protégé of conservative Sen. Jesse Helms, R-N.C., also served on a second appeals panel that overturned the conviction of Poindexter on similar grounds."

2. Precisely
The fix is always in - one way or another - they have people already in place to do their bidding.

And the control exerted over the Justice Department under Bush makes it that much worse.

Libby will get a new trial and Hera knows what will happen then. We should have known that justice is not for them, just us...

4. Sentelle doesn't exactly have a track record I'd trust
and though I might just get fooled...I'm not very hopeful.

12. I remember
a number of people saying that Judge Reggie Walton would never hold Scooter accountable, because Walton is a conservative republican. Those people dismissed my saying that Judge Walton was exactly who the case needed.

There is a danger that a judge with a neoconservative agenda will attempt to rescue Scooter. We saw how the 12 legal scholars who have an overlapping agenda joined to lobby Judge Walton, and there are, sadly, judges who are as disrespectful of the rule of law as those 12. I expect the Libby appeal to fail, and think that his chances of getting a pardon are becoming smaller each day. Still, nothing would surprise me.

13.  Sentelle just leaves a really bad taste in my mouth
Course, I still simmer inside over Iran-Contra and everyone and everything connected to it continues to bring a snarl to my face.

I'm banking on the other 2 to see to it that his appeal fails.

Does anyone know anything about Henderson? Is she a legitimate judge, or is she like Sentelle?

"The decision was signed by Judges Patricia M. Wald, Laurence H. Silberman and Karen LeCraft Henderson. Wald was appointed to the court by President Jimmy Carter, Silberman was appointed by President Ronald Reagan, and Henderson by President George Bush."

14. Gee, what a break for Scooter
David Sentelle, enabler of Ken Starr and avid fan of the Arkansas Project, will rule on Libby's appeal. And as the senior judge on the three judge panel, will probably sway at least one other member to rule the "right" way.

Nauseating. This spectacle is over. And the criminal cabal ruining our country will walk again.
