1. Magna Carta??
I am going to say he doesn't realize that the Magna Carta is not an American document. Other then that I suppose I agree, but its hard because its Faux.

4. Article 1, Section 9, Clause 2:
"The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it."

But the Magna Carta is the source of the IDEA of a written constitution, as well as the source of major concepts that went into the U.S. Constitution.

And to return to Habeus Corpus, there is an important issue: it does not protect against wrongful arrest, rather is a means to respond to it and be released. Likewise, protecting your home while being invaded by armed (sometimes with guns drawn) cops is not smart; but having a means to respond later and be made whole IS an important issue.

3. Technically correct that it's wrong, but ...
not smart to "defend" your home if police burst in with guns drawn -- a good way to get dead real fast.

Still, we need the right to sue them for it afterwards.
