Virginia AG To Sue Feds Over Health Care Reform

The attorney general of Virginia, Ken Cuccinelli, will file a lawsuit against the federal government should health care reform legislation be signed into law, his spokesman confirms to TPMDC.

The spokesman did not give details on what grounds Cuccinelli plans to challenge the law.

Last week, the Virginia state legislature passed a bill that declares residents exempt from any federal mandates requiring citizens to purchase health insurance. Similar legislation is pending, at various levels of seriousness, in some 34 other states.

In an op-ed last month, Cuccinelli praised the legislation for using the "vertical system of checks and balances between the states and the federal government" to challenge health care reform, which he believes is unconstitutional.

"This vertical system of checks and balances has been used too infrequently, but Virginia is now using it to declare our own law regarding health care freedom as a means to counteract an unconstitutional law (if it passes) at the federal level," he said. "This would create a conflict of laws."

McDonnell Issues Non-Discrimination Directive

In a surprising turn, Governor Bob McDonnell issued Executive Directive One today, directing that “No employee of the Executive Branch shall engage in any discriminatory conduct against another employee.”

In the directive, McDonnell wrote that:

Employment discrimination of any kind will not be tolerated by this Administration. The Virginia Human Rights Act recognizes the unlawfulness of conduct that violates any Virginia or federal statute or regulation governing discrimination against certain enumerated classes of persons. The Equal Protection Clause of the United States Constitution prohibits discrimination without a rational basis against any class of persons. Discrimination based on factors such as one’s sexual orientation or parental status violates the Equal Protection Clause of the United States Constitution. Therefore, discrimination against enumerated classes of persons set forth in the Virginia Human Rights Act or discrimination against any class of persons without a rational basis is prohibited.

6. Nothing to do with this utube, which I didn't totally understand, but
have you heard anything to the effect that now that Comcast owns MSNBC they are thinking of getting rid of Rachel Maddow and a few others, but her definitely? She might then go to CNN which just lost Amapour.

7. Oh My, I MOST Certainly Hate To Think That Comcast Is Going To "GUM-UP"
MSNBC, which I consider to be the only MAJOR MSM to cover PROGRESSIVE/LIBERAL issues! On a small scale because of no other access we had to use Comcast as our TV/PC provider for many years! Not that Verizon is without it's negatives, I couldn't wait to CANCEL Comcast and go with Verizon. I never signed up with them for my TV though since we've had a DISH for about 6/7 years! And of course DISH is ANOTHER Corporation, but you can't avoid them all!

I will say this though, DISH has been very good to us and I've NEVER had any problems with them, and since we've been with them for so long they treat us very well. We did a recent upgrade that got very mixed up and they were more than willing to provide us with an extra box at no extra cost! Guess they don't want us to bail on them, but still they didn't have to do it!

Off topic I know, but PLEASE don't let this be true! I have recently begun watching Dylan Ratigan a lot and REALLY like how he goes after the BIG GUYS, and I'd bet he's be one to be thrown under the bus rather quickly too!

I can watch alternative TV for my news, and do... but MSNBC is the ONLY major one I watch at all when it comes to 24 hour news! Can't remember when I last clicked onto CNN, it's been THAT LONG!! I have amazed myself by just not watching it EVER!!

Unfortunately COMCAST very well might want to shake things up, I just want the rumor to be false!!

9. I actually knew Ken Cuccinelli back in grade school
(He was "Kenny" back then) I never would have pegged him as the kind of far-right freak he has grown up into. I didn't know him that well, though- we were friendly, but not friends outside of school. I'd have probably been less surprised to learn what a fascist clown he's become if I'd known him in high school.

11. Funny how the GOP can ping-pong between advocating states rights and
federal authority when it comes to protecting insurance company profits. Kooky-nelli is afraid of "biggovernment" health care, but I bet he had no problem with Ashcroft raiding legal medical marijuana growers in California.

It's a crime against humanity that this nutjob got elected. Sometimes, I HATE being a Virginian and realizing how many idiots I live here with.
