Chamber Of Commerce Gets What It Wants On Tax Dodger Ban From Senate Committee

The U.S. Chamber of Commerce lobbied for the Senate Appropriations Committee to weaken a ban on government contracts with "inverted corporations," reports The Hill on Wednesday. Inverted corporations are domestic companies that set up nominal overseas headquarters to dodge U.S. taxes.

On Tuesday, the U.S. Public Interest Research Group raised hell about "a big corporate loophole" that found its way into the Senate version of an appropriations bill. The offending language says that the ban on contracts for inverted corporations "shall not apply to the extent that it is inconsistent with the United States obligations under an international agreement."

U.S. PIRG points out that many known tax havens, such as the Cayman Islands, are parties to international agreements that could exempt companies "based" there from the ban. The Chamber of Commerce says, "We don't want to be violating trade agreements."

Sen. Susan Collins (R-Maine) had no problem with the new language in the bill. Back in 2002, she had some very strong words about inverted corporations. From The Hill:


"These companies create phony foreign headquarters in a file folder or a mailbox to escape taxes and then use other people's taxes to turn a profit," Sen. Susan Collins (R-Maine) said at the time.

Collins, the ranking Republican on the Senate Appropriations subcommittee that considered the spending bill with the proposed limit on the ban, said Tuesday that she didn't think the new language would make it easy for companies to circumvent the law and escape taxation.

"That's not how I interpret it," she told The Hill when asked about concerns over the new language. "I do support the ban."



Seven of Collins's top 20 campaign contributors had a combined 437 subsidiaries in countries listed as tax havens or "financial privacy jurisdictions" in 2007, according to a December report by the Government Accountability Office.

Morgan Stanley boasted a whopping 273, Pfizer had 80, Cisco Systems had 38, Goldman Sachs had 29, Aetna had eight, General Dynamics had five, and Time Warner had four. The companies, which have billions in federal contract obligations, have given over $178,000 to Collins' 2010 reelection campaign, according to the Center for Responsive Politics.

Sen. Dick Durbin (D-Ill.), chairman of the subcommittee, did not respond to a request for comment from the Huffington Post. Durbin's top 20 donors for the current election cycle include Citigroup, Motorola, and Comcast, which have contributed nearly $100,000 to his reelection campaign. The GAO reported that Citigroup had 427 subsidiaries in tax havens in 2007, Motorola had four, and Comcast had three.

Ed Mierzwinski of U.S. PIRG, for one, doesn't buy the Chamber's argument that this is about the sanctity of foreign trade agreements.

"In Washington, the Big Lie works," wrote Mierzwinski in a blog post. "You make a claim that is so outrageous, no one will think you are making it up. In this case, the U.S. Chamber is claiming that unless we encourage offshore tax cheats by widening a loophole that encourages companies to set up a chair on the beach of a tax haven country and call it your headquarters, we will be in violation of our treaties and other trade agreements."

UPDATE: Good catch by The Hill: the Obama administration, in its 2010 budget proposal, called for exactly the same "international agreement" exemption that popped up in the Senate bill.

The Hill also reports that Susan Collins has reversed herself and would support the House version of the legislation, which does not include the exemption.

If it's even half the loophole U.S. PIRG says it is, it's surprising the White House would want it, considering previous tough talk on tax dodgers.

Obama administration called for offshore corporate tax loophole



The Obama administration called for the same provision tucked in a Senate spending bill that seeks to limit a ban on federal contracts for corporations that move their headquarters abroad in order to avoid taxes.

The proposed limit on the contracts ban for so-called "inverted companies" is part of the financial services and general government appropriations bill that the Senate is considering. The limit has come under fire from the nonprofit advocacy organization, the U.S. Public Interest Research Groups (U.S. PIRG), which worries that the move would hurt taxpayers.

The Senate bill includes a clause stating that the ban "shall not apply to the extent that it is inconsistent with United States obligations under an international agreement." The White House's 2010 budget proposal calls for the exact same clause.

The White House Office of Management and Budget didn't provide a response to questions about the new language.

The prohibition was first instituted in the 2002 Homeland Security Act. It initially applied only to contracts involving the Department of Homeland Security, but it was extended to other federal agencies in the 2009 omnibus appropriations act. The $787 billion stimulus includes a similar clause limiting "Buy American" provisions aimed at promoting stimulus projects for U.S. companies. The White House called on lawmakers to weaken the "Buy American" clauses after U.S. trade partners protested them.

3. As an example, THIS is what's wrong with government, right here.
It doesn't surprise me that the Republicans allow this, because of their hypocrisy. They want flat taxes, talk about morals, etc., etc. but what's THIS?

But the point where a person can see that "the game is rigged" and that "the little guy can't win", etc. is how much support such things (and I include general favoritism toward capital income versus earned income) gets from the Democrats as well.

The problem with our system is its lack of honesty. The suggestion that we ARE a 'democracy', from the REALITY that I see, IS A LIE. And that's the problem. Either we should BE a democracy, or like Japan, embrace our feudal / caste system...

UPS Was A Corporate Sponsor Of "The Contract On America," They Have An Overseas Shell Corporation based in Bermuda. Overseas Partners Limited, (OPL)sole design is avoidance of United States income taxes. The IRS won the largest back taxes judgment in history against them (UPS/OPL) in the late 1990's. The Bush administration dropped the case during the appeals process.

UPS's dislike of corporate responsibility is only exceeded by their comtempt for Democrats. I was repeatedly informed by upper management that Democrats were a pale shade of the Communist Party. Their lobbying organization, UPSPAC, one of K Street's biggest, gives overwhelmingly to Republicans. When I left UPS in 1992 I turned in testimony and documents that detailed their tactics of forcing supervisors and management into donating to UPSPAC. The Federal Elections Commission filed a charge against UPS, in which, after a four year legal battle UPS agreed to pay a fine and to never engage in this behavior again (never get caught again).

I turned over to the EEOC internal company documents that resulted in a sealed judgment against UPS for age discrimination.

I turned over to attorney David Mark of Seattle, Washington, documents that proved UPS was aware of tactics that resulted in employees being forced to work through their unpaid lunch hour. The documents proved that UPS was aware of these facts and were actually tracking the number of affected employees on a national level, in spite of years of legal testimony to the contrary. The case resulted in a multi million dollar judgment aginst the corporate entity.

UPS, may be an authoritarian dinosaur in the business world, but they are extremely astute in avoiding bad press. In fact press clipping are gathered at a national and world wide level and studied with an intent as to how to influence positive press coverage. Example: one of the biggest contributors to National Public Radio is the Annie E. Casey Fund, This fund is named after the daughter of UPS's founder Jim Casey.

5. Using their positions for personal gain
It's illegal to say, let a major campaign donor fix up your house in Alaska in return for favorable votes on legislation affecting the donor, but perfectly acceptable to take in large campaign contributions for the same thing! The campaign contributions should be like the Alaskan house. The media should be all over this since there has been more money donated in the name of this Health Care bill than ever before. The problem is that they own the media so there will be no outcry unless we make it. The single biggest threat to our nation is the control of our government and media, by business. Their money so manipulates the politicians, media and we the people, that we all exists only for their profit! We need the few media stars we have to try to rally the populous and get us out visibly and vocally at the national, state, and local level. Rome is burning!

6. Just a small part of the post........
One thing I noticed in the post was that she is already collecting money for re-election for 2010. They are so busy trying to stay in office that they do not have time to fix the problems now. This goes for both parties.

I have said it before and I will say it again, we need to take the parties out of government once someone is elected. Make the politicians stand up one by one and make them accountable without standing behind the party. When this country was founded there were not political parties. They started later.
