THIS HAS ME TERRIBLY UPSET.. and it should have everyone upset..and if it doesn't then I question everyone's judgement!

Seems some things never change..too bad we need Spain or other countries to lead the way in obeying laws and treaties!!!!!!

Obama to Appeal Detainee Ruling

WASHINGTON — The Obama administration said Friday that it would appeal a district court ruling that granted some military prisoners in Afghanistan the right to file lawsuits seeking their release. The decision signaled that the administration was not backing down in its effort to maintain the power to imprison terrorism suspects for extended periods without judicial oversight.

In a court filing, the Justice Department also asked District Judge John D. Bates not to proceed with the habeas-corpus cases of three detainees at Bagram Air Base outside Kabul, Afghanistan. Judge Bates ruled last week that the three — each of whom says he was seized outside of Afghanistan — could challenge their detention in court.

Tina Foster, the executive director of the International Justice Network, which is representing the detainees, condemned the decision in a statement.

“Though he has made many promises regarding the need for our country to rejoin the world community of nations, by filing this appeal, President Obama has taken on the defense of one of the Bush administration’s unlawful policies founded on nothing more than the idea that might makes right,” she said.

3. Yep. The Constitution isn't back yet. I guess the question is
will it ever be? That was why impeachment was so important.

I know I did not work my ass off for a democratic president for years only to see this "groundhog day" repeat,over and over again.
It's the FISA Flip Flops, this ..the Yoo protection, and all the Bush illegalities.. redeux..

I remember taking my son and his friends to the spot that the most famous legal document that assured the history of democracy ..was signed..the Magna Carta at Runnymede, England.
Our United States Constitution is predicated on the Magna Carta, and the rule of law, our very freedoms depend on Habeas Corpus and our right to appeal unlawful imprisonment.

Seems to me the new boss is nothing but a continuation of the old boss! And that scares the ever loving crap out of me!

Phones and Internet and ATM's.. fiber optics ..cut for a big area of California last week..a huge grid of California cut off ....and nary a word of it on any Major MSM...I never thought I would see this destruction of our democracy in my lifetime..but here it is folks..the end is near I fear.

"...Despite their efforts, the judge did not seem inclined to dismiss the lawsuit, which was brought by Jose Padilla, an American citizen who spent more than three years in isolation in a military brig as an enemy combatant.

The judge, Jeffrey S. White of Federal District Court, explored the arguments of Mr. Padilla’s lawyers thoroughly, but he appeared to be skeptical of elements of the government’s argument.

In fact, Judge White, who was appointed by President George W. Bush, even told the government’s lawyers that Mr. Yoo’s 2001 memorandum stating that the constitutional protections against unreasonable searches and seizures can be overridden was “a pretty scary position.”

The case, of course, could go in any direction, and predictions of judges’ rulings are often proved wrong. Nonetheless, the lawyers for Mr. Padilla left the courtroom smiling..."
