Cheney told Libby that bush said it was okay to leak Plame's identity
Nor would such documents of the CIA, NSC and the State Department place in context the
importance of the conversations in which defendant participated. Defendant’s participation in a
critical conversation with Judith Miller on July 8 (discussed further below) occurred only after the
Vice President advised defendant that the President specifically had authorized defendant to disclose
certain information in the NIE. Defendant testified that the circumstances of his conversation with
reporter Miller – getting approval from the President through the Vice President to discuss material
that would be classified but for that approval – were unique in his recollection.

******

From the actual court document.

Will Cheney and/or Bush say Libby is lying? It's the only way I see them getting out of it.

2. Not really. You are right that Libby said Dick said Chimpy said leak.
BUT, the intel leaked included Plame's info.

There is still some wiggle room in there.

3. Note that Libby also testified that he didn't disclose Plame's identity
to Miller on July 8 because he didn't yet know it. Timmy hadn't told yet, he claimed. Then later he said he forgot he knew, but denied telling Judy about Plame. That story was ok until Judy got tired of the slammer and spilled.

So far is there any evidence that the NIE contained Plame's identity? Libby didn't, so far as I can see from the Fitz docs, testify that he was authorized to leak her identity. Especially since Libby denied doing so.
