19. How, exactly, do presidential powers trump this:
"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

http://www.law.cornell.edu/constitution/constitution.billofrights.html#amendmentiv

Oh, right. They think the Constitution should be rewritten, and they shouldn't use the amendment process to do it.

What a bunch of freaking dictators.

Hatch- warrantless surveillance.

To be admissible, evidence would have to be lawfully obtained. Law is clear that President has the authority to do warrantless surveillance, if foreign involved.

Specter taking issue with Hatch- separation of powers
"YOu are not a judge". Judges make determination of constitutionality, not Senators.

Hatch "We make them every day..."

Specter- "Violates the principle of separation of powers'

GOOD. he is against having the Intell committee do the oversight.

Hatch trying to say that the President can just act and it may or may not be upheld by the courts. AS LONG AS ITS CLEAR THAT THEY HAVE DONE EVERYTHING TO COMPLY WITH THE LAW>

Well, guess what, Hatch, Bush did NOT do everything to comply with the law. He VIOLATED the law.
