A report by Congress's research arm concluded yesterday that the administration's justification for the warrantless eavesdropping authorized by President Bush conflicts with existing law and hinges on weak legal arguments.

The Congressional Research Service's report rebuts the central assertions made recently by Bush and Attorney General Alberto R. Gonzales about the president's authority to order secret intercepts of telephone and e-mail exchanges between people inside the United States and their contacts abroad.

Basis for Spying in U.S. Is Doubted

President Bush's rationale for eavesdropping on Americans without warrants rests on questionable legal ground, and Congress does not appear to have given him the authority to order the surveillance, said a Congressional analysis released Friday.

The analyses of the Congressional Research Service, part of the Library of Congress created in 1914, are generally seen as objective and without partisan taint, said Eleanor Hill, staff director of the Congressional inquiry on the Sept. 11 attacks.

Because of its importance, the report was repeatedly reviewed by senior staff members at the research service for accuracy and bias before its release, officials there said.

.....Congress has shown through legislation and statements over the years that it intends to regulate electronic surveillance and "it appears unlikely that a court would hold that Congress has expressly or implicitly authorized the NSA electronic surveillance operations," it said.

4. While I am excited by the headlines, and think they are long overdue,
I am wondering how they 'happened' to be released early Saturday morning, where a lot can get lost in the shuffle? Mind you, I'm not complaining toooo much, 'cuz I'd rather the MSM release them now, than not at all.

The non-partisan Congressional Research Service has released its report on the legality of domestic spying. It's conclusion: "the Administration's legal justification, as presented in the summary analysis from the Office of Legislative Affairs, does not seem to be as well-grounded as the tenor of that letter suggests."

The report, spanning 44 pages, carefully deconstructs each Bush argument. (Download the pdf here). Naturally, because no one has all the details about the program, the CRS reserved absolute conclusions about the legality of the program . While it stretched--and I mean stretched--to find a logical and legal basis in Bush's arguments, but time and time again, the law is not on Bush's side.
