Colorado: Teacher stays, student goes

Reporting that the teacher, in the Colorado high school, who compared chimp's and Hitler's tactics as being similar, is stating that the teacher is now back at school teaching.

The student has left the school because everyone is giving him lots of shit (back lash). The student is now attending another high school.

Street justice. Can I have an amen?

...the young man should be fined for taping the teacher. Why didn't he complain to his teacher, parents, or the principal about this behavior? He tapes the teacher and runs to MSNBC??? Sounds like a conservative set-up story. You can't secretly tape a teacher without permission... These people are nazis.

I just saw the story on MSNBC. It reeks like a set-up... I think they were going after the teacher. They should have taken the regular routes... maybe they did, I'm just goin by what I saw on this Joe Scarborough report. It seems like "created" news for this show.

22. I have followed this story pretty closely
and I don't think what he was doing is illegal. It was rude and obnoxious to be so sneaky about it but I don't believe it was illegal. Kids tape in class all the time. Kids with disabilities do it all over the country. So I doubt you can call it illegal.

Now I do believe he was wrong to go media shopping with his tape. He was wrong to not discuss his concerns with his teacher.

32. Depends on state law. In Penn. all parties must agree to be taped.
If you tape someone without their knowledge, you've committed a crime, and the tape will not be legally admissible for any purpose. Don't know what the Colorado law is.

They are guaranteed rights under federal laws. States can't override that. So I seriously doubt is is illegal.

it. in my state, you only have to have one person know. In Maryland, wasn't that the state Linda Tripp was in? ... you have to have both. There are states where if you do that, you go to jail.

The boy is a dick. His parents did him a big disservice and I'm proud of those at his school who let him know that what he did was unethical and wrong. I agree with street justice. Amen.

48. Colorado requires only one party notification...
to record phone conversations. In other words, when two parties are communicating, one can tape without the other's knowledge. Most states require that only one party be notified, but a few (like PA) require that all parties to be notified. Federal law requires only one. There are exceptions for businesses and a few other odd quirks.

But this is a classroom, which is akin to speaking in a public place where there would be no expectation of privacy. These laws would not apply here.

although it's good to applaud this decision, it should be noted that "justice" is very dependent on the political climate.

A couple of years ago this teacher could well have lost his job. The protections we think we have in a situation like this can be very slippery. You can never take anything for granted, especially when governors are advocates for the plaintiff. The teacher lucked out.

Our "freedoms" are fragile.
