Who's gonna call Arlen Specter on his 'magic constitution' theory?
I've been reading about Specter's argument that the President couldn't possibly have broken the law because FISA is unconstitutional by virtue of trying to regulate the President's inherent power as, well, President. I hope they don't start arguing that the 4th amendment is unconstitutional too but.. given who this is and the position he's now taken... granted, Senators are forbidden from speaking like this about their peers, but I'm not a Senator. Is it not time to mock this man as having invented a Magic Constitution Theory? (re: Magic Bullet Theory) Will this not resonate with the public at least a little more?

Just throwing this up for general discussion. I don't claim to have foolproof answers.

1. The President isn't given the power
to eavesdrop on Americans without a warrant. No one is. To say he is can be nothing but a fabrication in an attempt to cloud the issue. Specter's a drugwar cowboy and a raging ass with no respect for the Constitution in the first place.

What a dumbass, circular, bullshit argument. A first-year law student would get laughed out of a Con Law class on his/her ass for that one. Nice try, Arlen.

Listening to him today......was painful....the way he was talking he made it sound the president sound as if he were the King of the land.

If Specter was so concerned about FISA why didn't he work to eliminate it all together?

He had nothing today....I like that....Majic Constitution Theory...this is a phrase that could stick...

4. Hey, it was a pretty good bullshit for not having anytime to prepare...
He had to demand a copy of the speech at the beginning so he could at least have a few minutes to put something together. Don't be too hard on the old man.
