The SD anti abortion law WOULD put the woman in jail.
Edited on Thu Mar-09-06 09:48 AM by Inland
Other threads have noted the SD anti abortion law does NOT punish women for their own abortion.

http://womensissues.about.com/cs/abortionlaw/a/sdabortionban_2.htm
Nothing in this Act may be construed to subject the pregnant mother upon whom any abortion is performed or attempted to any criminal conviction and penalty.

However, OTHER Acts of SD would allow the woman to be convicted of conspiracy, accessory, and solicitation. IOW, the doctor is convicted under the anti abortion act, and the woman is convicted of the separate crime of conspiracy with the doctor to commit the doctor's felony.

http://legis.state.sd.us/statutes/DisplayStatute.aspx?Type=Statute&Statute=22-3-8

Some clever county prosecutor is going to figure this out and watch the SD legislators shrug their shoulders, "what can you do, those damn lawyers."

2. Frankly, if they've determined
that a friggin embryo is a human being and abortion is murder, they should be consistent and try both woman and doctor for murder. Guilty? Life imprisonment or the death penalty.

3. Right.
It's all a charade, it's all dishonest, it's all the inconsistencies and illogic of someone trying to do something that's really, really, really unpopular.

8.  I don't know.
The statute talks about "pregnant women", not embryos.

6. Exactly.
The fact that they don't shows that this isn't a "sanctity of human life" issue at all for them. It's just a way of dominating women. "Punishing" them with children for the crime of being "slutty".

7. Yep.
Because if they don't, then it is all just useless rhetoric.

4. I think South Dakotans should start calling up their local media
and asking "if it is true that plans for the construction of one or more women's prisons have been commissioned?" Just throw it out there. hmmmm

9. Is this a true statement? Has a study ever been made regarding these
statements?
Section 4. The Legislature finds that abortion procedures impose significant risks to the health and life of the pregnant mother, including subjecting women to significant risk of severe depression, suicidal ideation, suicide, attempted suicide, post traumatic stress disorders, adverse impact in the lives of women, physical injury, and a greater risk of death than risks associated with carrying the unborn child to full term and childbirth.

10. It's an absolutely false statement.
The risk to women of legal abortions is much less than childbirth. I think the Surgeon General in the Reagan Adm. was asked to give an opinion, and oopsy daisy, confirmed that.

12. You know, the more I think of it,
that paragraph is the "woman as victim" rationale, where SD is trying to protect our childlike, mentally incompetent womenfolk from unscrupulous men and doctors who cause them to have abortions for their own fiendish purposes.

13. It certainly appears that way to me also. If the study can be
proved that those are erroneous statements. This must be challenged vigorously.

I've been around for a great many number of years and have known scores of women that have had abortions and not one of them have been effected by such claims as was reported in that document.
