Federal agency sues Hooters over waitress with MS

ROCHESTER, N.Y. A federal agency is suing the Hooters restaurant chain on behalf of a Rochester waitress with multiple sclerosis.

The Equal Employment Opportunity Commission lawsuit claims Hooters discriminated against Melissa Vicari by not scheduling her for shifts she was able to work.

Vicari worked as a Hooters Girl between 1998 and 2004 and had medical clearance.

The lawsuit asks for back wages, compensation and changes to the restaurant employment policy.

Rochester station W-H-A-M reports that a statement from Hooters says it will fight the lawsuit.
