…from KNX1070: "A Woodland Hills man who allegedly sent letters containing white powder to Jon Stewart, David Letterman and incoming House Speaker Nancy Pelosi, among others, pleaded not guilty today to charges of mailing threats."

…and from CBS News:

"Assistant U.S. Attorney Donald Gaffney requested no bail, saying Castagana was a flight risk and because of "his mental health state." Outside court, Gaffney said he could not discuss Castagana's mental state."

1.) Odd. I don’t recall a criminal Prosecutor asserting that a defendant is mentally disturbed before. Wouldn’t “insanity” be an argument for Defense?

2.) While I’d agree that Mr. Castagana is probably mentally ill, I can’t believe that this makes him a flight risk. Quite the contrary. Where would a 39-year old man who is still dependent on Mom and Dad possibly go? I doubt that he’d survive much further from his driveway, let alone in Canada and Mexico. (Imagine that!)

1. his mental state may refer to

his lack of a job, no family outside his parents, his lack of ties and his ability to run and hide.

It does not necessarily refer to not having the requisite ability to distinguish from right and wrong, and not having the ability to determine that a course of action would be illegal.

directly to the other Freeps so they can all get their jollies watching the torture.

3. His "mental health state" might get worse if he can post on internet forums

where he gets support for his delusions of adequacy. You know the kind of place ... Being kept isolated from that kind of place might be the best thing for his health.
