2. Screw that "pay the fine" noise. Screw the fine.
The HOA prez is the one "in the wrong" here. People
should be sending these folks money for a lawyer
to SUE his stupid ass for civil rights violations.

I think he may have exposed himself to PERSONAL liability
for this one, and I'd like to see him called to account
for it. It would be a nice warning to petty tyrants everywhere.

11. Two things happened after the Board sent the first letter -
1) The Board consulted with an attorney who told them that the Association did not have the powers that they had "read into" the governing documents and therefore they had opened up the Association to a major lawsuit.

2) Their activities had made them personally liable for the harassment.

The Association's insurance carrier would not provide (pay for) the defense of the Association or the Board members because it is a requirement that they make "good" business decisions. Firing the architectural advisory board instead of following their recommendation is clear evidence that they did not make a good business decision - they made a personal/emotional decision. A definite no no.

...at which point they started crying, "It was just a misunderstanding"!

Pfft. I still hope they get sued, and sued hard. Petty neigborhood
thugs like this need to be slapped down, and often.

13. I agree - the family needs to sue.
These authoritarians who take over Associations/Boards need to have the shit scared out of them and bitched slapped into the adjoining neighborhood.

Peace sign Christmas wreath can stay

DENVER A Colorado woman can display her Christmas wreath shaped like a peace sign after all.
The homeowners' association in the Pagosa Springs subdivision where Lisa Jensen lives has withdrawn its threat to fine her 25 dollars a day unless she removed the wreath.

Several residents had complained, saying the wreath was either an anti-war protest or a sign of the devil. The homeowners' association ordered Jensen to remove the wreath from her house on the grounds that it doesn't allow flags or signs that are considered divisive.

Jensen tells The A-P she got a letter from the board last night that called the incident a "misunderstanding...

14. Just a feeling on this....
...but this came up shortly after the mid-term elections and I have the feeling that the HOA prez has to be a total RW nut who STILL supports the War and Terra and the US being in Iraq. So...and am thinking that anything that even slightly smacked of being liberal, he was in an attack mode. He got Jensen's neighbor for a small peace sign right after the elections ~~ the sign was the size of a plate as IIRC. Then he went after Jensen and her husband. IMO, if the Repukes had won the election, I don't think this controversy would have come about.
