How many GOP votes are needed to block Scalito if Dems unite?
Not very many! I say we merely shift our efforts in that new direction! Kick if you agree!

... there's 45 with Chaffee, 44 without. With Cheney's ability to break a tie, one needs all the Democrats, Jeffords and six Republicans.

Wasn't he in an auto accident? So, wouldn't that be one less vote the Dems would have to find? What are the numbers, I wonder.

Let's see, at the time Kerry gave his speech today, there were 56 declared votes for Alito. Were there more votes delared after that? Were there any Republicans at all who voted against cloture? Should we assume that all the Republicans will vote for Alito, just because they all voted "NO" on cloture? Chafee and Snowe both had not declared at the time Kerry spoke, although perhaps they did later, and I just didn't catch it.

No, I just don't think there's any chance. All they need is 50 to confirm, so even if Ensign doesn't vote, using the 56-34 numbers, that would mean at minimum we would have to turn 3 senators to block Alito, and get everybody else to vote "NO." And Chafee and Snowe were still being shown as "undeclared" at that time. I don't think we could do it. I think that positions have solidified even further in these last few days. Even presuming that the total of voting Senators will be 99 (with Ensign gone), instead of 100, and presuming that all the Dems still undeclared at the time of that tally and both Chafee and Jeffords vote against Alito, that's still 54 to 45, isn't it? That would require turning over 5 Senators still. Nope, just can't do it. It would still be interesting to take a look on the final predicted tally, going into tomorrow, though.

I still am having fantasies of Harry Reid pulling a rabbit out of his hat, but I think that's lack of sleep.

Oh, I'm sure we'll pick up a few votes, Democrats who'll want to cynically say they voted against Alito--when in fact they voted for him in the only vote that counts and maybe a few moderate Republicans will jump ship now that the danger of his not actually being confirmed is past.

Even then there will still be a few oblivious to everything but their re-election.

Guess how that one's going to play once Ol'Karl starts using the flip-flopper strategy against you. Ask John Kerry about that one.

Even a smaller Repub margin in the Senate would help a lot because I don't think all the Repubs would vote for the nuclear option.
