Alito/Padilla - "Enemy Combatant" case

The government has delayed this case going to the supreme court by filing for the transfer. They did so one day after Padilla's lawyers filed a "cert" (request to transfer the proceeding to a higher court) with the court.

Theywant to make sure Alito is on the court....

If enemy combatant status along with the ability to transfer from "enemy combatant" incommunicado status to criminal courts comes with all the evidence pressured out of a detainee...this will mean the end of Miranda.

Secret NSA spying, declare someone an enemy combatant secretly, then render to someplace for torture, they can then legally return the detainee to a criminal court for trial and public punishment. All to show how effective the war on terror is.

The constitution will no longer apply.

Right now the court is set to approve of deny the cert "in due order".
