First case re: habeus corpus filed for detainees? NPR report

on Morning Edition. I think it was this item.

Not near a computer where I can check it out to verify. Just wanted to get this on the board. This attorney was filing on behalf of detainees to demand that evidence be brought or they be released. He has filed to get it into the courts before the signing of the bill this week.

Is this the step that needs to get the bill into the courts to be heard possibly by the SC and ruled unconstitutional?

I'm wondering how long it will be before they find a reason to suspend habeas corpus for some lame quasi-terrorism reason that is actually political?
