Alaska Legislature Mulling Making Murder Legal

A bill sponsored by the Republicans expands the circumstances during which a person can use deadly force in self-defense.
<snip>
defend themselves or others from serious crimes such as robbery or rape.
<snip>

It’s a carbon copy of a bill passed in the Florida Legislature last year. Passage of similar bills across the nation is being encouraged by the National Rifle Association.
<snip>
Alaska law already allows people to use deadly force in their own homes or when they can prove they could not have escaped their attacker. Senate Bill 200 permits deadly force even if a person could have fled their attacker and protects the person from civil liability.
<snip>
A lot of gun guys are angry at us for talking about this, because it’s not really a gun issue. It’s an issue of murder. Look at Colorado, where a man was cleared of any wrongdoing, even after chasing another man down and stabbing him in the back, because he used this defense to claim he’d been threatened. The gun lobby is trying to push the line that this law will make people safer against criminals, but the only thing it will do is allow violence in more places and more situations. All Americans have the right to self-defense– we’re not arguing that. But “Shoot First” is trouble because it claims we have a right to kill. “Shoot First” is, without question, a license to murder.

1. I'm thinking this is politics... Because in Alaska...
Probably about 10 years ago maybe more, I was a waitress at a 24 hour family restraunt who worked the graveyard shift.

There was this guy, he was poor and white. Anyhoo we all knew him, he would come in for coffee in the early am hours and stay till approx 6 am. He didn't say boo to me, I would just refill his coffee, but some of the bussers knew him.

So he goes home one evening and apparently he was at the wrong house/trailer (can't remember which) and thought he was locked out. He climbed in the window and was shot dead.

It shook out that he did live next door.

He made a tragic mistake, but the homeowner was not prosecuted because he was defending his property and the guy was shot inside his home.

3. I remember reading about a case a while back about a minister who killed
a couple of men. He heard a noise in the building next door which was a church where he preached, and got his gun and went next door and caught two young men in their late teens or early twenties and he started shooting. Neither man had a weapon of any sort. One of the boys ran out the back and was running away and the preacher after shooting and killing one man charged out after the other guy and shot him in the back as he was fleeing. The Preacher got off on a self defense plea. This also happened in Alaska. It was about a year ago and discussed at some length here on DU.

4. How do you prove self-defense?
And will this let all those hate crimes go because they'll all find a way to say "self defense, he was looking at my kinda funny".
