Judge Anna Diggs Taylor's decision and the Supreme Court
I think it's pretty safe to say that the NSA spy case will end up in the Supreme Court. How many courts will hear the case before it gets to the SC? And what's your best guess on how they will rule given the current makeup of the court?

1. That's not a safe bet. There's good chance the appeals court will reverse.
The ACLU would appeal, but the Supreme Court then is likely to deny cert.

5. But it only take 4 supremes to grant cert. and hear the case
So I think the odds are pretty good that they would considering the importance of the case.

2. I would think that Kennedy is going to be the swing
We know where Alito, Thomas, Roberts and Scalia are going to be on it.

3. My off-the-cuff prediction
is that the Bushies (+Gonzales leading the charge) will cry "state's secrets!" and "protecting the homeland" and the whole thing will thenceforth be adjudicated in secret proceedings.
If this is the case, then tyranny really will ave won. :(

4. Yep
1) It will be uphelp by the 6th circuit
2) It will be upheld by the SCOTUS

However, the wording of the decision will need a major overhaul

7. It'll definitely go to the USSC, and there they'll retool the law somewhat

and excuse everything BushCo has done ILLEGALLY thus far.

All of the ill-begotten info they're continuing to collect, on ANYone they're collecting it about, will be allowed to remain buried. They'll never be held accountable.

They will be required at some point to get warrants -- I can't see any way around that -- but I think they'll continue to pursue their secret, illegal domestic spying anyway, perhaps with more levels of secrecy.

And I believe what the Nixon White House did is NOTHING compared to what these criminals are doing.
