Scooter Pie
Here is a link to a new article that anticipates some of what can be expected in Monday's court hearing. Note the two "possible" defense strategies: to say Scooter simply "forgot"; or to say the reporters are wrong. The two concepts seem mutually exclusive.

13. It is funny
how a guy who claims he was so darned busy protecting America that he plum forgot that his boss had told him Ms. Wilson was a CIA employee, and which he discussed with at least 7 other officials before forgetting again, also claims he has perfect recall of the conversations he had with three journalists. I am reminded of Nixon's attempts to make some things "crystal clear."

5. Could We Also Learn Something Else On Monday
Besides insights on Libby's case?

"Judge Walton, as he has done in previous hearings, is likely to ponder whether Special Counsel Patrick Fitzgerald's investigation is actually nearing conclusion. Because Fitzgerald has indicated that the investigation is ongoing, the judge has allowed the Special Counsel to withhold certain documents dealing with President George W. Bush’s deputy chief of staff, Karl Rove, which Libby's attorneys contend are crucial to their preparing a defense."

The state of where things stand with Rove?

14. I anticipate
that we will find out the areas that both sides agree on, and information that both sides do not have to agree on. But there may also be areas that are hotly disputed, that Judge Walton reserves judgement on.

It seems very likely that the news organizations will have people on this Monday. I think that we can look forward to David Shuster's reporting.

7. "...anticipated claims of testimonial privilege."
Something like, "Cheney's testimony is key to my defense, but no one can force him to testify, so you gotta let me go."

In all cases, it seems like Scooter's a drowning man, grasping at anchors.

15. It may be
that on Monday, Mr. Libby will turn into an anchor. He may become a weight on VP Cheney. And all the fund-raising that VP Cheney is behind will not change that.

Also, much like the kid in school who takes a smug stance when confronted by a teacher, because he thinks, "You don't realize who my parents are."

9. I've been thinking about this very stagey and suspcious 500 lb bomb drop
on that many-lived cat, Zarqawi, and assorted unimportant human beings who may have been standing anywhere nearby whoever it was they pulled out of the rubble and put onto a gurney as he died, or didn't put onto gurney. And I'm thinking: Bombshell from Fitzgerald? (Rove would know. Bush would know. The Dark Lord at the Pentagon would know. Precision bombing of the nation's front pages, was it? Could be--likely will be--stretched into next week. Pre-emptive narrative of "victory" in Iraq; all past sins forgivable; a hundred thousand deaths of unimportant human beings, and a few dead US counter-proliferation agents, who cares?).

Just a guess (that Rove and maybe Cheney are going down next week).

10. Similar thoughts here...
When I first heard that Zarq was dead, I figured Fitz was about to announce that Rove was indicted. Seems too conveninet that BOOM! And all the media is talking about how the most evil terrorist was dead (what happened to Osama Bin Laden!) So what does Bush NOT want the media to talk about? Rove? Cheney? Haditha?

11. Interesting.
The more I think of the lengths this group will go to, including "perception management" on a global scale, the less I believe anything that comes from the administration and is reported in the corporate media. It's a strange time, and I often wonder just how far some will go to avoid having to let the reins of power slip from their grasp.

16. Their Means Of Manipulation Can Be Very Subtle
Last week there was a story that George I was trying to talk his son into getting rid of Rumsfeld. I had to ask why. After all haven't they (so far) gotten precisely what they've wanted? The rich are getting richer, Carlyle will control our ports and Hallibuton and the oil companies have swelled with American dollars. Why would they change course, given that they don't care a flying fig for what the public or the world thinks? My conclusion is that it's the good cop/bad cop routine. They don't want the family name so blackened that neo-con Jeb won't be permitted to continue the job George has started. Thereby, with the father saying "stop the madness" the family, itself, doesn't look so bad, just the one member. Cynical I know. But look at who we're dealing with. These are people who should never be believed. not one word, and should always be questioned.

19. It is a strange time. Try explaining to young children, who have known
no other occupant of the White House, that the position used to be respected. Try to teach your children the importance of truth when we have such a culture of deceit and deception.

20. Some of these criminals, the RW extremists, are capable of anything
and "perception management" is heavily relied on.

Btw, like other members I have a lot of respect for your input here H2O Man.

For those that desire more background on "perception management" here is a thread from our archives from this past January.

21. I LOVE IT!!!
Legal Times magazine, in its analysis this week, writes, "although it's common for perjury defendants to blame a faulty memory for any misstatements, that strategy is far from a sure thing. It's especially risky in a major political-corruption case, where there are dozens of witnesses ready to counter that claim."

24. Here's another good article - link
<snip> Although the faulty-memory claim is sometimes successful, it could be a particularly difficult sell for Libby’s lawyers to make in this case, says Solomon Wisenberg, a criminal-defense lawyer with Wisenberg & Wisenberg in the District.

"It looks like Fitzgerald will be able to present evidence . . . that this was such an important matter to the White House, and specifically to Libby, that professions of forgetfulness are not reasonable," says Wisenberg, who served as deputy independent counsel during the Whitewater and Monica Lewinsky investigations and conducted the grand jury questioning of then-President Bill Clinton.

http://www.law.com/jsp/dc/PubArticleDC.jsp?id=1149002726751&hub=TopStories

<snip> Fitzgerald plans to call Cheney to testify. If the vice president is called, experts say it’s unlikely he would be able to dodge providing testimony by citing executive privilege.

<snip> "The government will argue the vice president’s involvement would have made the whole matter so salient to Libby that anything he said to investigators would have been incredibly thought out, not haphazard and forgetful," says Dan Richman, a law professor at Fordham University and a former federal prosecutor in the Southern District of New York.

But Richman says it’s possible Libby’s lawyers might use Cheney’s testimony to their own advantage.

"I think there will be an effort by Libby to portray himself as a sacrificial lamb of higher-ups — that he was sort of put in a bad place and forced to protect others,” he says. “If done right, it could lead jurors to have some sympathy for him."
