Here's what I sent to the Boston Globe. (Sent a variation to the NY Times in response to this article)

Subject: Alito's amazing revelation (how can Savage have missed it??)

In response to a critical question posed by Sen. Biden, Judge Alito made an amazing revelation. The gist of the Senator’s question was this:
"If the men and women in Congress, as representatives of the people, had passed a resolution that the United States MUST NOT attack Iran, could the President lawfully and constitutionally order an attack on Iran?"

Shockingly, Judge Alito asserted that he did not know whether or not the President had such authority: that he would have to wait until he was presented with a specific case to figure it out.

If we take him at his word, his insane assertion that our simplest and most absolute tenets are "open questions" makes him so dangerous that even the most reactionary Senators would reject him out of hand if his statements ever penetrated their thick skulls.

I don't understand how Charlie Savage ("Little ammunition for filibuster as hearing nears end") missed this. Judge Alito is literally telling us he doesn’t know if the United States of America is a fascist dictatorship or not. That's more than a "little ammunition" for a filibuster.

Here's the letter referenced in the orginal post:

Subject: Alito's shocking revelation

To: Sen. Dianne Feinstein

January 13, 2006

The rumor mill is buzzing that you intend to vote to confirm Judge Alito. I hope the rumor is wrong, particularly in light of Judge Alito's response to a critical question posed by Sen. Biden today. The gist of that question was this:

"If the men and women in Congress, as representatives of the people, had passed a resolution that the United States MUST NOT attack Iran, could the President lawfully and constitutionally order an attack on Iran?"

For any sane person, the answer would be "Absolutely Not!"

I was shocked when Judge Alito said he did not know whether or not the President had such authority; that he would have to wait until he was presented with a specific case to figure it out.

He is literally telling us he doesn't know if the United States of America is a fascist dictatorship or not.

This menace to our most basic tenets must be stopped, but pundits throughout Washington are already predicting the Democrats will stop short of engaging in a serious battle against his nomination.

Prove them wrong.

Sen. Frist's threat of "going nuclear" cannot be allowed to deter you. The perception of Democrats as weak is a serious problem. The only solution is to fight these critical battles with everything you've got, whatever the outcome.

To Everyone who can get to DC:

Pay Your Senator a Visit!

Stop by Reid's and Durbin's offices -- Tell them you are counting on them to rally the troops!

Stop by Biden's, Feingold's, and anyone else on the committee that came on strong and thank them!

Sure, you will probably just talk to a receptionist or a member of the staff, but there is nothing more powerful than actual constituents showing up at their doors!

That's What Happened on January 6th!

They were flabbergasted by ordinary (non-professional or manipulated activists) people acting in their sovereign capacity, simply demanding their "leaders" do their duty!

And, you don't have to go to DC. Show up at a local office!

I called and emailed my NY senators for the second time. I know that they will already vote NO, but we need all of our Dem Senators to support a filibuster. So if you haven't called already, call withFILIBUSTER in the message.

From flyarm's i just spoke to Bidens office...about Alito

when i spoke to Senator Bidens phone answerer...

he refered me to todays NYT and said it said it is possible that none of the 9 Senators will vote <for> alito

but he did tell me i should be contacting Senator Nelson of Nebraska..

that he could be the lone dem voting <for> Alito..

please please please....

may i ask each and every Du'er to get on the phone and make a call to Nelson of Nebraskas office...and demand he not vote for Alito...

. . .great to see what others are doing -- or what they heard from Senate offices when they called.

If you do send a letter through the Congress.org site, you have the option of including it with the other Letters to Leaders (if you do, you could post a link to it here).

Check out some of the letters on Alito from others.
