52. I just called Feinstein's office - this is what her staff said:

He said that a filibuster is "unlikely".

but I had already sent out an "Action Alert" to my local pda other local activists groups to call Feinstein's and Reid's offices.

I've spoken to staff at Sen. Reid's office to let them know that it was imperative that Alito is not seated, that DP goes forward with a filibuster and told the staff how Alito can be defeated - and that's with a 41 vote or more on the filibuster, and 51 votes or more on the so called "nuclear option".

That's how to defeat this nomination. But the party must stand together.

and then we have to move to bring on moderate republicans for the 51 nuclear option vote.

Reid's staffer said, "Ok - I'll tell him"...

He noted (1) that a panel of active judges testifying in a consent hearing ws unprecedented and (2) that should Alito be confirmed he'd be hearing appeals to THEIR findings.

This is very important. How can any Circuit Court of Appeals judge testify in OPPOSITION to Alito knowing that Alito would probably be hearing cases they decided?

This is an unethical panel.
