Interesting post on FireDogLake. RE: Rove, Fitzmas, etc.

1. A dkos member met Joe Wilson this weekend and spoke to him for 20 min. About 4 min was about Fitz and Plame. Since it was off the record, he didn’t provide details. But he wrote (as a comment in one of the diaries) Wilson said in effect something big (implying Rove) is going to come down in the next few days and something really really big (implying Mr BigTime) in the next few weeks.

2. Larry Johnson confirmed to Jeralyn that he was the one that wrote the commnet in DU endorsing Leopold’s report and that he heard samething from Wilson. (Active guy, that Wilson).

3. Wayne Madsen (WMR) reports that he staked out at the court house on Fri and he saw a procession of SUV’s that came to the court.
He thought that was AG Gonzo, taking a brief from the court (prosecutor or judge, not clear) that Rove was going to be indicted.
This report by itself didn’t make sense, but Madsen says same thing happened with Libby.
On a Fri in Oct, Gonzo went to courthouse, got the brief on Libby, the following wednesday Libby was indicted, on that Fri Fitz held the press conf.

4. Now I have settled in with my own Conventional Wisdom. Real indictment (vs Leopold’s indictment) comes this Wed, Fitz stays in DC on Thurs to prepare for presser, Fitz sees the judge on Fri AM to brief on the indictment, calls the presser with a couple of hrs notice, announce the indictment and do some Q&A with press, and then goes home, watching himself on CNN at DC Reagan airport along the way.

Leopold will hopefully get a "sorry" from his impatient detractors. I wonder what the really, really big news is?

9. My immediate thoughts were unindicted and indicted co-conspirators.
So far Fitz has stayed an Ocean away from bringing conspiracy charges. That may have been a big leverage point in the flurry of in camera evidence Fitz shared with the jusge. Conspiracy goes to the heart of the case.

Agree, people really need to be patient - this is all being done on a place and time of Fitz's choosing as he wants the most leverage possible. Fitz for reasons known unto himself is the person in charge and he is choosing based on his case and where the evidence led him. It was not by accident that Darth Cheney debuted this past Friday in the proceedings. The longer the wait, the more mistakes and opportunities arise for the suspects to make mistakes. It's not a crime show drama where its solved in 47 minutes without commercials.

12. maybe he's going after a conspiracy charge........
we already know he has evidence on Cheney (Wilson't NY Times op ed with Cheney's notes all over it) so there was clearly a concerted effort from Cheney, Libby and Rove to discredit Wilson.

I believe there WILL be a Rove indictment whether it comes now or later. That's why the Leopold article is so easy to believe. We all know Rove is going down, it was only just a matter of time............

18. Discrediting Wilson isn't a crime. Outing Plame, lying to a GJ are crimes
In order to establish a conspiracy, there has to be an intent to commit some sort of crime - it can be attempted bank robbery, it doesn't have to come off as planned.

It seems that a conspiracy charge would be much more difficult to establish than plain old Obstruction of Justice or Perjury. Establishing the underlying crime of conspiracy to violate the Intelligence Identities Protection Act (IIPA) is enormously difficult, but there seems to be adequate evidence to do it, if that's that's the direction Fitz want to move in. You'd need one or more cooperating witnesses to prove such a case, which I think Fitz has.

Still, I think the case against Cheney is going to come down to simple misrepresentations he made in his earlier conversation with Fitz about his involvement in the effort to ruin Wilson and out Plame.

Leopold’s indictment? It's beginning to look more and more like a pipe dream of wishful thinking. I'm P.O.'ed about this entire rant against the media who 'never speaks the truth to power' and then, on the other hand, lies are substituted for facts, when the pressure is great enough to 'get the story out and be damned with the sources', even if it's an established fact that the sources are probably liars themselves.

4. Interesting how potential Rove indictment has become an issue in itself
- I hope it is all true. I heard about the 'liberal' blogs & this story on Cspan this morning. If you think that we are holding are breaths for this to happen think about all the Freepers worried that the other shoe is about to drop. Cheney & Rove deserve to be indicted and sent to jail - lets hope they get their just reward.

8. Gonzales is recused from the case, reportedly he also was a witness
in the investigation. Madsen's report has Gonzo "as a formality" being able to question the grand jury and tip off the white house as to upcoming indictments (thus violating grand jury secrecy) in a case from which he not only recused himself due to his close association with subjects/potential targets of the investigation and was involved as WH Counsel in the matter being investigated? Seem likely that Fitz and the court would allow that? Fitz has the powers of the US AG in regards to the Plame investigation/case, not Gonzales.

Madsen reportedly saw a motorcade, assumed it was Gonzo and from that assumption alone spun a dubious story, which adds nothing.

As the poster said, the report doesn't make sense.

1. Wilson. And he would know something because..........well, he wouldn't, would he.

2. Counting SUVs and thinking..just thinking...one is carrying the AG. Hey, it's a basis for a guess. Maybe it's even right. But it's still a guess.

15. My only concern is
that it will happen late Friday afternoon like Limbaugh's arrest. I don't care when it happens as long as it happens, and it will happen this week. But it would be much better if it happens earlier in the week and not later.

16. Makes perfect sense.
The grand jury was probably polled Friday. Indictment tomorrow. Press conference to follow. The White House is lying. No surprises here at all.
