So, isn't this not just about the government having the record but your boss...or your soon to be ex-husband in a divorce action? If it is a government kept record, isn't there a danger that anyone can get it through the freedom of information act? I don't really know...anyone here set put my mind at ease?

1. Also about the whistle blowers... they can find out who's calling
what journalist.

Nevermind that the leakers are usually ON THE SIDE OF THE AMERICAN PEOPLE, and are DEFENDING OUR RIGHTS!

2. They'll deny it with state secrets privilege

5. if they want to...but if they WANT to give out the info...they will
which means your boss can get it...is my guess...

I think FOIA makes keeping phone records very dangerous. You sue a big company, they get your phone records, you complain about the government, they have your records, you have a girlfriend and you don't want that information public..that you called her...they blackmail you into keeping silent.

I'm not a tin-foil-hat 1984 type person but this bugs me and it should bug everyone.

3. I don't know? It's an interesting question though. About 2 1/2 years
ago, my (now Ex) DIL was cheating on my son, and I found out she had made several calls to her BF from MY HOUSE! I call Bell south to ask for a record of the calls made from my home phone during the month of XX. They said they COULD NOT GIVE ME THAT INFO! Apparently they are forbidden to give that info to anyone except the police, and only with a court order!

Since it's been so long, and she has since left my son, it probably no longer matters, but I find it interesting that they readily gave that same info the Feds WITHOUT A WARRANT but claimed they were not permitted to give it to ME, the person who pays the damn bills!

4. right, they can't give it to a private person but once the government has
the information, it is easier to get through FOIA. (I thought you could get your own phone records!)
