Roberts File Vanished Before Nomination

The Case of Roberts's Missing Papers
Investigators Are Still Unable to Locate File On Affirmative Action

The country has John G. Roberts Jr. as its newest chief justice. What it doesn't have is an answer to the mystery of the missing file of his work papers on affirmative action.

The file, compiled during Roberts's tenure as an associate counsel in the Reagan White House, vanished in July when lawyers from the Bush administration were reviewing the materials at the Ronald Reagan Presidential Library in Simi Valley, Calif., as part of a vetting process before Roberts's formal nomination to the Supreme Court.

A newly released report from the National Archives inspector general's office shows that federal investigators failed in their first attempt to nail down what happened to the file, which became a flashpoint in Roberts's otherwise smooth confirmation process.

"This investigation is unresolved and the file is still missing," says the 64-page IG report, released in response to a Freedom of Information Act request from a Washington area researcher and posted Tuesday on the Web site Memory Hole. ". . . The OIG was unable to determine whether the missing file was taken intentionally, unintentionally, or lost."

Roberts and his wife did not do that. The two children were born in Ireland, less than 4 1/2 months apart to two different mothers. Roberts initially put out the story that they were adopted "from Latin America". Since both kids were "stunningly" blonde, questions were raised. According to Time magazine, the children were born in Ireland. From what I can put together, the biological mothers traveled with their children to some unnamed Latin American country to avoid Irish law. Then under the laws of that Latin American country, the mothers signed over their kids to the Roberts. There are typically large sums paid out to adopt kids under such circumstances, in addition to the costs of travel. Reading about the background of Mrs. Roberts, she is and always has been practically fanatic in her opposition to abortion and has been extremely active in various organizations opposing abortion.
She is a highly skilled lawyer. Technically the adoptions are legal. However, when it comes to getting what they want, neither of the Roberts displayed any respect for the spirit or meaning of the law of the country where these children were born. Rather they used their power and wealth to circumvent the law. I also note, evidently they made no effort to find adoptable children in the U.S.

The Washington Post reported that in 1996, when Jane Roberts married John, she was 42 "and Catholic doctrine prohibits most forms of fertility treatment." That's why they adopted, and it is of GREAT SIGNIFICANCE that the Roberts are so rabidly anti-abortion, that they chose not to use in vitro fertilization, which would have been a violation of Roman Catholic law, but had no compunctions about violating the law of another country, Ireland.

So how were the children adopted? According to The New York Times, based on information from Mrs. Roberts' sister, Mary, Torre, the children were adopted through a private adoption, i.e.,the birth parents relinquished their parental rights directly to the adoptive parents, instead of to an adoption agency.
