1. In this case "detained" apparently means questioned for a couple of min.
The cop questioned him then a couple min later leaves without telling him to cease and desist, sounds more like poutrage than an actual civil rights issue.

I live and shoot in NYC and I've had a cop question me a couple of times, no real big deal except for one time when it was quite obvious someone had their douchbag hat on that day and because technology is our friend and I really didn't want to get in a pissing match I offered to erase the photos to make him think he won, then walked away, switched cards and used recovery software and got the pics back.

Actually we get more hassled over tripod use than security issues so you have to get a little creative, personally I use my bike and a gorillapod.
