Two of my photos published in a national magazine !
Hi Everybody !

Pages 16 & 17 of the June/July Issue of Mother Earth News.


Mother Earth News has an online Community Forum where subscribers can share photos.
A few months ago, I uploaded some photos of our place in Arkansas. Last month, they called and asked permission to publish two in their magazine.

These are the two they chose.




Oddly enough, I never cared for either of these photos. :shrug:
The colors are nice in the first, but the butterfly is flying in the wrong direction (can't see the eyes), and the vegetable shot just seemed "common" to me. But I chose not to argue with their photo editor.

A word of caution:
I asked the editor if he wanted me to send a "permission to publish" release for the photos, and he informed me that I gave up ownership of my photos when I posted them to their website, and that he was calling me as a courtesy, and to check spelling.
So be careful with your photos and the internet.

2. Whoever told you that you gave up ownership
Whoever told you that you gave up ownership rights was not correct. Here is the relevant portion of Mother Earth's terms and conditions:

By posting a message, uploading a file, providing information to, communicating with, or otherwise placing any material on our websites, you are granting the Mother Earth News and its affiliated newspapers, a royalty-free, perpetual, non-exclusive, unrestricted right and license to use, copy, modify, display, archive, store, distribute, reproduce and create derivative works from such information, in any form, media, software or technology or any kind now existing or developed in the future. Without limiting the generality of the previous term, you authorize Ogden Newspapers to share the information across all Ogden Newspaper locations, other Ogden Newspaper websites and to use your name and any other information in connection with its use of the material you provide. All rights in this term are granted without the requirement for additional compensation of any sort to you and without further permission required.

That license did give them the right to publish it without your permission, but you still own the rights to the photo. They have the right to do whatever they want with the copy you uploaded to their site (including making more copies, photoshopping it, selling coipes of it. The only real limitation the license grant places on your rights, however, is that you can no longer grant exclusive rights to someone else since Mother Earth will perpetually have a right to use their copy. (You can even still sell your rights in the photo - but the new owner sill still be bound by the license agreement to Mother Eartyh.)

That said - your point is a good one. If you care about your copyrights in your photos (not to say you should . . . ) you need to read the fine print before uploading photos (or anything else that might be protected by copyright) to a site you do not own.

After thinking about it, I guess that most magazines would have the same legal arrangements.

3. Woo hoo and here Ter brought home the magazine
because they had an article on how to make cheese. :rofl: Congrats and a good reminder to read all TOS and fine print when uploading a photo. The photos look great in the magazine and on here.

11. Hi, everybody!
Thanks for the kind words.

I really miss this forum!
One of the downsides of moving here was the loss of broadband.
The dial-up link here is too slow and erratic to stay current in The Photo Group.

When we first moved here, I used to drive 20 miles into the nearest town with my laptop, and sit in the parking lot of a motel with wireless broadband so that I could participate in this group.
I still watch for the contest threads and vote when possible. :hi:
The work from this group has gotten very good.
