Accused GI won’t face death if convicted

HONOLULU — A Hawaii-based soldier accused of killing an unarmed Iraqi last summer will not face the death penalty if he is convicted of premeditated murder, an Army lawyer said Wednesday.

The most serious punishment a court-martial could level on Sgt. 1st Class Trey Corrales is life in prison without parole.

Corrales, of San Antonio, is accused of shooting an unarmed Iraqi after his platoon captured the man during a raid on a house suspected of harboring men who were planting roadside bombs.

Corrales is accused of leading the man outside the house, telling him to run, and then firing several shots into him as he backed away.

Premeditated murder can carry the death penalty in military court. But Maj. Gen. Benjamin Mixon, the 25th Infantry Division commander and the court-martial convening authority in this case, decided the alleged crime didn’t warrant it.
