BOLLING AIR FORCE BASE, Washington, D.C. — The court-martial of Col. Michael D. Murphy, the senior Air Force lawyer who was discovered to have been disbarred for more than 20 years, began Monday with a brief arraignment before the Army judge who will preside over the trial.
Army Col. Stephen R. Henley, the Army’s chief trial judge, ruled that hearings on pretrial motions will begin June 23 and the trial itself will begin July 21, though the trial date is tentative.
Murphy faces trial by general court-martial on nine counts of conduct unbecoming an officer and a gentleman, one count of failure to obey a general regulation and three counts of larceny greater than $500.
Murphy, who was relieved as commander of the Air Force Legal Operations Agency after his disbarment came to light in November 2006, was present at the 35-minute proceeding but spoke little. He appeared glum in the courtroom and kept his gaze fixed on the table in front of him when he was not addressing the judge or speaking to his lawyers.
He did not enter a plea or choose whether to face a jury or bench trial, at which the judge decides the verdict and punishment. Henley granted requests by Murphy’s attorneys that both decisions be delayed until preliminary motions are heard.
