Blood Alcohol Level test was excluded from a trial because of unknown error rate
Edited on Tue Jun-28-11 06:18 PM by Theo Haffey
BAC test has been taking heat as of late. Authorities don't even know how accurate their tests are; this made a judge throw out the blood alcohol test on an accused drunk-while-driving person's trial last month in Michigan:

"Michigan’s 79th District Court Judge Peter Wadel refused to admit blood-alcohol results in a drunken-driving case because the state crime lab does not report an error rate, or margin of error, along with blood-alcohol results."

2. What? The standard for the old Breathlizers was + or - .01.......
and those were the state of the art from the 50's forward. The sworn statements always had this included then. It appears modern technology just doesn't work as people become more & more lazy.

4. From what I understand, a lot of the technology is proprietary...
and companies that make the devices don't want to cough up the data.
