Calif. Supreme Court Upholds Scouts Ouster

The California Supreme Court ruled Thursday that Berkeley did not violate the rights of youth sailors connected to the Boy Scouts of America when it demanded marina fees because the group violates a city anti-discrimination policy.

The city revoked free berthing privileges for the Berkeley Sea Scouts because the Boy Scouts bar atheist and gay members, which violates the city's 1997 policy to provide free berthing to nonprofits that don't discriminate.

The free speech case challenged the legality of removing or withholding public subsidies from groups whose ideals run counter to the government.

The justices ruled Berkeley, celebrated in the 1960s as the home of the Free Speech Movement, could demand that a group receiving subsidies renounce a policy of "invidious discrimination."

Even way back when I was a wee little rebellious gay scout in Germany I refused to bow my head in prayer in meeting after meeting at the scout hut on the military kaserne in Germany and finally got demerited and assigned some nasty stuff for not being obedient.

For my "punishment" the scout master made me repaint the outside of the whole scout building over the weekend (army green) and think about what scouts meant to me, and my Dad went along with their punishment.

So I painted like a motherfucker all Saturday and then spent my accumulated allowance on a gallon of shocking pink paint from the PX, walked the mile or so back to the kaserne, and painted pink polka dots, big ones, little ones, three dimensional ones, Salvador Dali ones, and even a square polka dot or two. All over the army green scout hut, over the doors, the windows, the walls, the soffit and trim. I even had some soldiers stop by and ask what I was doing dangling from the eaves with a dripping pink paint brush. I told them it was a special project I had been ordered to repaint the scout hut and someone would probably paint it back green again soon.

Well they pulled me out of school on Monday - and said if I wanted to stay in boy scouts I had better repaint the whole hut. I got like, thirty years of detention, and my dad got in trouble because I had defaced military property, but the scout master did admit he told me to repaint the hut but not what colors to use, so they had to drop it.

I've always had a problem with it. Do scouts ask little old ladies if they're god-fearin' heterosexuals before offering to help them across the street? I guess I missed that part in my scout manual.

I can just imagine what it looked like. :-)

I was in the Scouts for a day. They started marching up the school hallway and I started marching in the other direction and right out the door.
