Release expected soon in Kansas teen same-sex case
Matthew Limon could be out of prison as soon as the weekend.

Limon has served five years of a 17-year sentence for having consensual sexual relations with a 14-year-old boy when Limon was 18. If his partner had been female, he would have served a sentence of no more than 15 months. But the Kansas Supreme Court ruled last week that it is unconstitutional to treat people differently just because the act was homosexual.

On Thursday, the court expedited its process of issuing final orders, a legal procedure that normally takes 20 days. The move, which came at the request of Limon’s attorneys, means Limon will be released as soon as a Miami County district judge agrees. That could come any day. Limon has been held at the Ellsworth Correctional Facility.

The ruling changed a state provision dubbed the “Romeo and Juliet” law that allows lesser penalties for illegal sexual relations when both individuals are teens close in age. The law applies when partners are age 14 to 19 and less than four years apart. But until last week’s ruling the law applied only when relationships were heterosexual.

5. Oh that is fucking incredible!
After scumbag Phil Kline said he didn't plan to appeal to the court, now he's delaying any release while he reviews the case.

I'd call Kline a douchebag, but at least a douchebag is useful on occasion. I can't wait until this scum-sucker goes down in defeat!

6. Arghhhh
I am so sorry that my state is so fucked up. This just really pisses me off on so many levels. It is so wrong to prosecute more time because it was same sex sex but then I am also pissed that somehow it makes women seem of less concern. Either way this is just wrong. Double L Phill has competition in his next run, someone who has been said in KC to be popular so we can always hope. I have no idea where he falls on this issue but I will try to find out.

7. OK ... even later breaking news ... he's been released!
(from the Associated Press)

Prosecutors were weighing an appeal to the U.S. Supreme Court on Thursday after a ruling by the state's high court led to the release of a man jailed for performing a sex act on an underage boy.

Miami County District Judge Richard Smith said in court that he could not set Matthew Limon free because he had not been able to find a governmental agency to supervise his release. That problem apparently was resolved after the hearing and the defendant was turned over to family living in western Kansas.

Poor Matthew Limon has been in and out today more times than Richard Simmons!

Miller said he felt the high court wrongly interpreted the Romeo and Juliet law, which mandates lighter sentences for illegal sex when partners are 14 to 19 years old and less than four years apart.

"I think the Legislature's intent was clear that it was to apply to members of the opposite sex," he said.


This attorney obviously didn't read a single word of the opinion. The court said the law must apply fairly regardless if someone was homosexual or heterosexual. The legislature's intent is moot because their intent in unconstitutional.
